Fredericksburg Restaurant Inspections: Dairy Queen, China Inn
Several restaurants around Fredericksburg, Stafford, and Spotsylvania recorded violations during the most recent health inspections.
FREDERICKSBURG, VA — Several restaurants around Fredericksburg recorded violations from the health department during recent inspections. More than a dozen locations received flawless inspections.
The most recently published inspections occurred between March 9 and March 15.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions.
They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.
Here are the most recent violations as listed by the Rappahannock Area Health Department:
- Dominion Raceway- Grandstand Building Main Concession Area, 6501 Dominion Raceway Ave Woodford, VA 22580

- Total violations: 1
- The interior of the deep fryer cabinets were observed soiled.
- Holiday Inn Express & Suites, 6415 Dan Bell Lane Thornburg, VA 22565
- Date inspected: March 9

- Consumer self-dispensing bulk food bin containing the following food item(s) is not properly labeled: Cereal
- Charter Senior Living, 20 Heartfields Lane Fredericksburg, VA 22405
- Date inspected: March 9

- Observed absence of active managerial control during the inspection. Through discussion and direct observation the person in charge is not monitoring handwashing of food employees, separation of raw and ready to eat foods, monitoring multi-stage cooling of TCS foods, adequately cleaning and sanitizing food contact surfaces and offering eggs cooked to order for highly susceptible populations from unpasteurized shell eggs. Discussed requirements during the inspection.
- The person in charge could not provide documentation of the employee health policy, however, food employees were knowledgeable of health reporting requirements. Provided sample policy during the inspection.
- Observed the following: 1- Food employee removed crack egg shells from the shell egg container wearing single use disposable gloves, remove gloves and then prepare to don new gloves without washing their hands, 2- Observed a food employee handle soiled equipment at the dishwasher and then proceed to remove sanitized equipment from the dishwasher without washing their hands and 3- Observed a food employee handle their cell phone and then proceed to remove a large stainless steel bowl from a shelving unit with their bare hands without washing their hands. Instructed food employees to wash their hands and discussed handwashing requirements during the inspection. Instructed the person in charge to run the equipment through the dishwasher which were handled by the food employee.
- Observed unpasteurized shell eggs and raw bacon stored over ready to eat foods (cooked sausage, packaged pasteurized liquid eggs) in the 1 door upright cooler #1. The raw foods were relocated to prevent contamination.
- Observed two fryer baskets located on top of the fryer soiled. A food employee reported they were not used today. Instructed the person in charge to remove the baskets to be cleaned.
- Through discussion with a food employee the prep table is sanitized only, a wash step is not being conducted. Instructed the food employee food contact equipment require a cleaning and sanitization step. The person in charge agreed to comply.
- Observed interior plastic lip of the ice machine soiled.
- Observed peas and carrots in the steamer unit (88 degrees F) which were placed in the unit to be reheated but were not monitored. The person in charge reported they were placed in the unit at approximately 12:30 p.m. The person in charge reported they would be cooled for reservice and placed them in an ice bath. The peas and carrots were in a deep covered plastic container and placed in an ice bath. Discussed separating the food into thinner portions to facilitate cooling but this was not conducted. Instructed the person in charge to to cool the peas and carrots to 70 degrees by 1:30 since the exact time was unknown when the peas were removed from refrigeration. Observed the peas and carrots at 85 degrees F at 1:55 p.m.. The person in charge voluntarily discarded the food for safety. Discussed cooling time and temperature requirements.
- Observed package of sliced deli turkey with a label identifying the date of opening as 3/2/2022. The food should have been discarded on 3/8/2022, The person in charge voluntarily discarded the turkey for safety. Discussed date marking and disposition requirements.
- Observed the following TCS foods without date marking to identify the date of preparation or discard: 1- Pureed ham, sliced deli ham, and various opened packages of precooked vegan sausages. The person in charge could not verify when the packages were opened and voluntarily discarded for safety.
- Through discussion with the person in charge, unpasteurized shell eggs are used to prepare eggs, cooked to order upon a residents request, and may be ordered and served undercooked (over easy). Informed the person in charge this is not permitted for highly susceptible populations unless the facility purchases pasteurized shell eggs. Instructed the person in charge to thoroughly cook shell eggs to 145 degrees F. Recommended purchase of pasteurized shell eggs. The person in charge agreed to comply.
- Observed plastic and stainless steel food storage containers stacked while wet after cleaning and sanitizing.
- The person in charge could not provide an irreversible registering temperature indicator to monitor surface sanitization of the high temperature dishwasher.
- Accumulation of debris was observed on the following nonfood contact surfaces: Cooking equipment, top of knife holder, dried oatmeal bin, upsplash of the coffee brewer and cart in the dry storage room.
- The floors, walls, ceiling, caulking at the drainboard of the dishwasher and 3 compartment sink, and ceiling light covers throughout the facility are in need of cleaning.
- Observed the following in poor repair: Gap in ceiling tiles near the cooking area, ceiling tiles not secured to the frame in the warewashing area, blown out shielded light under the hood and duct tape around a sprinkler head in the ceiling of the dry storage room.
- Observed the floor near the 3 compartment sink drain and walls of the lower half in the warewashing area are not smooth or easily cleanable.
- Observed 26 foot candles of light at the cookline. Observed one blown out shielded light bulb and observable debris on the exterior of the shielded light covers.
- Soulific Seafood (286-962), 6 Vaughn Ct Fredericksburg, VA 22405

- Observed the floors, walls and ceiling in the mobile unit in need of cleaning.
- China Inn, 312 W Broaddus Ave Bowling Green, VA 22427
- Date inspected: March 10
- Total violations: 15
- Observed an uncovered drink on top of the prep unit. Drink was discarded during inspection.
- Observed an employee scooping cooked rice with a small plastic container without a handle. Employee was instructed to use a scoop with a handle to scoop rice.
- Observed two soiled cleavers and two knives stored on the c lean knife strip over the prep table. Knives and cleavers were taken to the 3 compartment sink to be cleaned.
- The cavity of the microwave oven was observed soiled. Oven was cleaned during inspection.
- Observed a bottle of aspirin stored on the expo station above the prep unit. Bottle was removed during inspection.
- Outer opening of the food establishment is not protected against entry of insects and rodents. Observed large gaps along the edge of the outer screen door in the kitchen.
- The cardboard lining the bottom shelf of the prep tables and the foil on the rice cooker is not smooth and easily cleanable.
- Observed that the door on the chest freezer is broken and does not close tightly which is causing a heavy buildup ice to form inside of the unit.
- The following non-food contact surfaces are in need of cleaning: 1-the dry storage shelving, 2-the knife rack above the prep table.
- The drain pipe under the 3 compartment is leaking. Attempts to repair the leak with gorilla tape have not worked
- The cardboard attached to the screen door id not smooth and easily cleanable.
- The ventilation system over the wok station is not working.
- The following physical facilities were noted in need of cleaning: 1-the ceiling tiles throughout the kitchen, 2-The floor sink near the clean pot rack, 3-the drain pipes under the 3 compartment sinks.
- Observed that inadequate lighting was provided on the cook's line (7 foot candles) and prep area (11 foot candles).
- Observed a cell phone stored on the expo shelf over the prep unit. Phone was relocated during inspection.
- 2400 Diner, 2400 Princess Anne Street Fredericksburg, VA 22401

- Total violations: 8
- Observed one spoiled onion in a 50 lb bag of onions. During the inspection, the PIC discarded the onion. (Corrected)
- The following were at improper temperatures: 1. One large stainless steel bowl of cooked cubed potatoes (62F, prepared on 03/07/2022) in the 4 door reach in cooler. 2. One plastic food container of cubed honeydew (55F, prepared at 9am) in the server's glass reach in cooler. During the inspection, the food was discarded. (Corrected)
- Observed 2 bottles and 1 box of medication being stored above the prep table. During the inspection, the PIC relocated the medication. (Corrected)
- The following equipment are in need of repair: 1. The bottom shelf of the reach in freezer is cracked. 2. The floor in the walk-in cooler is coming apart.
- Observed rusted shelves in the 4 door reach in cooler and walk-in cooler.
- The following are in need of cleaning: 1. The wall and vent behind the 4 door reach in cooler. 2. The wall between the dishwasher and prep unit. 3. The floor in the walk-in cooler.
- The following are in need of repair: 1. A section of the ceiling (drywall) is missing in the dry storage room. 2. The ceiling over the stairs is peeling. 3.The wall between the dishwasher and prep unit.
- Observed personal items (jackets and purses) hanging on racks containing food and utensils/equipment in the ice machine room.
- Dairy Queen Grill & Chill, 10907 Courthouse Road Fredericksburg, VA 22408
- Date inspected: March 14
- Total violations: 7
- Observed the dishmachine not operating properly- the concentration of the chlorine is 0 PPM- a technician is coming to service the machine within a few hours. Employees will use the 3- compartment sink to wash, rinse, and sanitize.
- Observed the following TCS foods cold holding at improper temperatures at the prep unit across from the fryers: 1- one container and one bag of pre-cooked chili (48-50'F) 2- several portioned two ounces containers of homemade ranch that contains dairy (49-52'F), 3- a container of shredded cheddar cheese (48'F) , 4- a container and four bags of cut lettuce (43-46'F). The person in charge reported that all the items were placed in the unit three hours prior to temperature check, except for the homemade ranch dressing- items were placed in the walk-in cooler and ranch was discarded. PIC will discontinue use of the refrigeration unit to hold TCS foods until evaluated by a technician.
- Observed several plastic containers of 2% Milk and ice cream mix on the floor in the walk-in-cooler.
- Observed the following: 1- the prep unit across from the fryer is not operating properly (55'F). 2- The walk in freezer was observed with a large accumulation of ice on the floor and on the ceiling of the freezer that may prevent necessary maintenance and easy cleaning.
- The following are in need of cleaning: 1- interior and vents of cooling units, 2- shelving units by the dishmachine.
- The following areas were noted in need of cleaning: 1- ceiling (to include vents) by the dry storage area and the dishmachine area, 2- the wall under the 3 compartment sink and by the soda dispensing area.
- Observed the hood system and filters soiled with grime and debris
- Stafford Senior Cafe, 1739 Richmond Highway Stafford, VA 22554
- Date inspected: March 15
- Total violations: 2
- Observed that the interior of the ice machine requires cleaning.
- Observed that the can opener holder requires cleaning.
- Taco Bell #33516, 3551 Plank Road Fredericksburg, VA 22407
- Date inspected: March 15
- Total violations: 1
- Observed food employee wash hands in less than 10 seconds and under running water. During the inspection, the food employee rewashed hands before returning to work. (Corrected)
- Wendy’s, 5801 Plank Road Fredericksburg, VA 22407
- Date inspected: March 15
- Total violations: 7
- Observed the temperature of the front line handsink (94-96 degrees F) and the pick up window handsink (97 degrees F) was less than 100 degrees F.
- Observed numerous sheet trays with a very heavy build up of grime and debris and are no longer easily cleanable.
- Observed several stainless steel containers that were stored stacked while wet.
- Observed the pick up sandwich prep holding unit (56 degrees F top, 44 degrees bottom) is not reaching the required temperature of 41 degrees F. Facility is will be using time as a public health control to monitor temperatures of TCS foods until unit gets fixed. During the inspection the person in charge placed a call to a technician.
- The following non food contact surfaces were observed soiled: 1.The upsplash of the two tea brewers and upsplash of the drive through soda machine. 2. The wire rack used to hold clean equipment near the 3 compartment sink.
- Observed the following: floors underneath equipment are in need of cleaning, the wall near and floor drain underneath the 3 compartment sink are in need of cleaning.
- Observed floors throughout the facility were in poor repair, grout was missing throughout and near the utility sink floors were severely damaged and cracked.
- Living Hope Child Development Center, 325 Courthouse Road Stafford, VA 22554
- Date inspected: March 15
- Total violations: 4
- Observed dispensing utensils in a drawer that had debris on them. The person in charge placed the items in the 3-compartment sink for cleaning.
- Observed that the quaternary sanitizer bottles measured over 400 ppm. The Person in charge disposed of the bottles.
- The person in charge could not provide a device for measuring high temperatures on the dish machine. During this inspection, the person in charge ordered high temperature self-adhesive tapes.
- Observed that the gaskets on the refrigeration units require cleaning.
