Fredericksburg Restaurant Inspections: Poet's Walk, Tropical Smoothie
Several restaurants around Fredericksburg, Spotsylvania, and Stafford recorded violations during the most recent health inspections.
FREDERICKSBURG, VA — Several restaurants around the Fredericksburg region recorded violations during the most recent round of health department inspections. The most recent inspections occurred between April 6 and April 12.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions.
They can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or they can temporarily shut down an establishment until certain issues are solved.

- Sam’s Pizza & Subs, 17069 Patriot Hwy Ruther Glen, VA 22546
- Date inspected: April 12
- Total violations: 5
- Observed an uncovered drink stores on the prep table near food. A lid was placed on the drink during inspection
- Observed 3 dented cans of pizza sauce on the dry storage shelf. Can were re-located to the damages goods shelf during inspection.
- The interior of the ice machine and the blade of the can opener blade was observed soiled. Ice machine and can opener blade were cleaned during inspection.
- The surface of the cutting board along the cook's prep unit was observed stained. Board was taken to the dish room to be cleaned.
- The following non-food contact surfaces were observed soiled: 1-the outside of the reach in cooler, 2- the bulk storage bins, 3- The side of the flattop grill.

- Observed two moldy onions in a container. During the inspection the person in charge discarded the onions.
- Observed the interior surfaces of the ice machine were soiled.
- Observed one container of sauerkraut with a disposition date of 3/28. During the inspection the person in charge discarded the item.
- Observed the facility is not using pasteurized eggs for their residents. Person in charge stated raw shell eggs will be used for baked goods.
- Observed a container of air freshener and a container of stainless steel cleaner stored next to an open box of parchment liner paper and a basket of clean linen. During the inspection the person in charge relocated the cleaner and air freshener.
- Observed 4 boxes of food stored directly on the floor of the walk in freezer. During the inspection the person in charge relocated items to a shelf.
- Observed ice build up coming from the condenser at the back of the walk in freezer and on the air curtains.
- Observed the facility does not have a thermometer or test strips for the high temperature dish machine.
- Observed the following non food contact surfaces in need of cleaning: The bottom of the knife holding block, the outside surfaces of the bins containing dry ingredients (flour, breading, etc).
- Observed the following in need of cleaning: floors underneath equipment and throughout the kitchen, floor drains and ceiling vents.

- No hot water at the handwashing sink next to the prep sink and men's restroom. Person in charge is waiting for parts to repair handwashing sinks.

- The interior surfaces of the ice machine, which were in contact with a non-TCS (temperature controlled for safety food)(ice), was observed soiled. The machine was cleaned during inspection.
- In discussions with the person in charge it was learned that the blender containers used to mix smoothies containing TCS (temperature control for safety foods) were not being sanitized as often as required. The person in charge stated that the containers were being sanitized only at night after closing. EHS informed the person in charge that the blender containers need to be cleaned and sanitized every 4 hours.
- The food contact surface of the cutting board along the prep unit was observed heavily stained. Board was taked to three compartmentr sink to be cleaned during inspection. Informed person in chrage that if it did not become clean, they could get a hand sander and sand down the surface until the stains were gone.
- Wiping cloths improperly stored between use. Observed wet wiping cloths stored on the 3 compartment sink. Cloths were places in the dirty linen bag during inspection.
- The floors under the equipment throughout the kitchen are in need of cleaning.

- Observed a colander in the handwashing sink. During the inspection, the food employee relocated the colander. (Corrected) Observed a food employee filling a spray bottle at the handwashing sink. EHS informed food employee that the handwashing sink is only for handwashing. (Corrected)
- The person in charge (PIC) could not provided a working food temperature measuring device.
- Observed a food employee wearing a bracelet and watch while preparing food. During the inspection, the food employee removed wrist jewelry. (Corrected)
- Observed a food employee working in the kitchen without a hair restraint. During the inspection, the food employee applied a hat. (Corrected)
- Observed a stack of styrofoam cups next to the handwashing sink (located below the monitor) and a box of delicatessen paper on the prep table next to the handwashing sink that were not protected from contamination. EHS recommended splash guards at the handwashing sinks.
- The exhaust fans in both restrooms were observed soiled.
- The following are in need of repair: 1. Missing floor tile coving in front of the walk-in cooler. 2. A hole in the women's restroom wall.
- Observed Red Bull drinks and keys on the prep table and a Red Bull drink on a shelf over the prep table. During the inspection, the food employee relocated the items. (Corrected)

- Observed that the interior of the ice machine requires cleaning. The person in charge cleaned the machine during this inspection.

- The 2 reach in freezers along the side hallway are not easily movable or sealed to the floor.
- Observed areas of walls, floors, and ceiling that are not smooth and easy to clean throughout the facility.
- The 3 compartment sink faucet is leaking.
- Two of the lights in the dishwashing room are missing shield covers.

- Total violations: 9
- Through discussion with the person in charge the back prep table, which is used in contact with food, is not being cleaned prior to sanitization. The person in charge reported a degreaser or Peroxide disinfectant is used prior to rinsing and sanitizing with the food grade sanitizer. Instructed the person in charge to clean the food contact surface prior to sanitizing. The person in charge agreed to comply.
- Observed the following TCS foods cold holding at improper temperatures on the far left side of the pizza prep cooler (top): Sliced ham (47 degrees F), diced tomatoes (45 degrees F), sliced provolone cheese (45 degrees F) and shredded parmesan cheese (45 degrees F). The person in charge reported the TCS foods were held in the unit overnight and voluntarily discarded for safety. Discussed storage of Non-TCS foods in the far right side of the unit until evaluated by a technician and to monitor food temperatures every 3 hours.
- Observed harboraging conditions in the food establishment including accumulation of equipment which have been soaking in open containers of water for at least 5 days, unnecessary equipment being stored in the facility, water on the floor in the warewashing area and accumulation of debris throughout the facility.
- Observed boxes of packaged food stored under leaking lines in the walk in freezer. Observed significant amount of frozen ice under the condenser unit in the freezer. Instructed the person in charge to relocate the foods during the inspection but this was not completed.
- Observed accumulation of grime and debris on food contact equipment including interior and exterior of hot holding and cold holding equipment, exterior surfaces of plastic food containers, pre-wash spray nozzle, basket under and on top of the dishwasher, exterior surfaces of cooking equipment and shelving throughout the facility. Recommend a thorough and deep cleaning.
- Observed long hose with a spray nozzle sitting on the floor, with the water turned on, connected to a Y-connector at the mop sink without adequate backflow protection. Instructed the person in charge to purchase a dual check value backflow preventer to prevent backflow and back siphonage of water. During the inspection the person in charge disconnected the hose.
- Observed equipment and accumulation of boxes and other debris is the back storage room by the walk in cooler. Discussed removing equipment not being used or planned to be used in the food establishment.
- Observed the floors, walls, and ceiling vents and ceiling light covers throughout the facility in need of cleaning.
- Observed vents above the fryer and vents and filters above the pizza oven soiled.

- The following were soiled to the sight and touch: a ladle, several knives, the food contact surface of the tomato slicer, several containers. The person in charge removed the items to be washed, rinsed, and sanitized.
- Observed five employees cups and two cellular phones stored next to single service articles and food. The person in charge relocated the items.

- Per discussion with the person in charge the food contact surfaces of the milk shake mixer used on dairy which is a time/temperature control for safety foods (TCS) is not being washed, rinsed, and sanitized every four hours or when contamination occurs as per the food regulations. The mixer is wiped with a towel every four hours and only get washed, rinsed, and sanitized only once a day. EHS explained to the person in charge cleaning frequency of equipment with TCS foods. The person in charge washed, rinsed, and sanitized the equipment.
- observed the dispensing utensils improperly stored between uses, utensils were stored with the handle touching the food. Corrected during the inspection.
- Accumulations of debris were noted on the following non-food contact surfaces: shelving units throughout the facility, air curtain above the exterior door, the exterior and the non food contact surface interior of all cooling units, cup dispenser, the cabinet under the soda machine in the dining room area.
- Observed a hose attached to a Y connector at the mop sink with a sprayer attached to the hose. The person in charge removed the sprayer and hung the the hose until a back flow prevention device is installed.
- Observed the plumbing fixtures in the female restroom in the dining area in need of cleaning.
- Observed the ceiling (including vents) , walls, and floors throughout the facility in need of cleaning.
- Observed the following in need of repair: 3- compartment sink needs to re-caulked, faucet needs to be fixed in the 3- compartment sink, missing coving by the exterior door, broken light shield.
- Observed the hood system and filters soiled with grime and debris.

- The equipment being cleaned in the dish machine were not observed sanitized. There was no measurable sanitizer being dispensed into the machine. The 3 compartment sink was set up during the inspection to sanitize equipment. Person in charge will make a call to have the machine repaired.

- Observed food employee washing her hand in less than 10 seconds. During the inspection, the food employee rewashed using the proper handwashing procedure before returning to work. (Corrected)

- Observed food employee wearing a bracelet while prepping food. EHS informed food employee of jewelry while prepping food. During inspection, the food employee removed the bracelet. (Corrected)
- Observed wet wiping cloths throughout the prep areas. During the inspection, the food employees removed the wet wiping cloths. (Corrected)
- Observed plastic food containers over the 3 compartment that were stacked while wet after cleaning and sanitizing.
- The two cutting boards at the 3 compartment sink were observed heavily scratched
- The following are in need of cleaning: 1. The wall above the 3 compartment sink. 2. The ceiling tile around ceiling vents. 3. The floor under all equipment. 4. The mop sink basin.
- Observed lights out in the dishwashing/dry storage area and in the women's restroom.
- Observed a phone, keys, and a personal beverage on a shelf over the prep tables. Also, observed a box of BandAids, 1 spill kit and 2 purses on a shelf over a box of granola. (Corrected)

- Observed a hose attached to a faucet fixture at the mop sink. The hose extended below the flood rim level of the sink basin.
- The plumbing connections below the sink are leaking. The person in charge stated that this will be repaired today.

- Date inspected: April 7
- Total violations: 20
- Observed absence of active managerial control during the inspection. The person in charge is not monitoring temperatures of TCS foods during cold holding, hot holding and improper storage of toxins were observed during the inspection. Also observed TCS foods which were delivered within on hour prior to commencement of the inspection sitting on the floor in the kitchen. Discussed importance of active managerial control and prompt storage of TCS foods received. During the inspection a food employee placed the food deliveries in refrigeration units.
- Observed a food employee fill a stainless steel container with water from the only handsink in the kitchen. Informed the person in charge handsinks are to be used for handwashing tasks only.
- Observed uncovered containers of spices at the bar which are used to prepare beverages, without adequate overhead protection. During the inspection a food employee placed a plate over the containers to prevent contamination.
- Observed raw squid stored over covered container of cooked shrimp in the 2 door reach in cooler and raw beef stored over covered container of cooked rice in the 2 door upright cooler #2. The raw animal foods were relocated to prevent contamination.
- Observed interior of the ice chute soiled.
- Observed pork (126 degrees F) hot holding at improper temperatures in the steam unit. The person in charge reported the pork was cooked at approximately 12:00 p.m., temperature was observed at 1:20 p.m. The pork was removed to the range to reheat to 165 degrees F or higher by 2:00 p.m. Observed the pork reheated to 173 degrees F at 1:45 p.m.
- Observed the following TCS food cold holding at improper temperatures: 1- Black beans (56 degrees F) on the counter upon arrival. The person in charge reported the beans were pulled from the refrigeration unit at 12:30 p.m., temperature was taken at 1:18 p.m. The black beans were relocated back to the refrigerator to cool to 41 degrees F or less by 4:30 p.m. 2 - Observed container of oil, garlic and crushed red pepper holding on a countertop at 61 degrees F. The person in charge reported the mixture was prepared and placed on the counter at 12:30 p.m. The person in charge will use time as a public health control and discard the oil and garlic mixture at 4:30 p.m., a note was placed on the bowl. 3- Observed a container of rice (45 degrees F) and lettuce (46 degrees F) stored in a small amount of ice on the countertop behind the cook line. The person in charge reported the TCS foods were placed in the ice bath at 12:30 p.m., temperature was noted at 1:15 p.m. The facility will use time as a public health control and discard the rice and lettuce at 4:30 p.m. Discussed ensuring adequate quantities of ice are use to maintainer TCS foods at or below 41 degrees F and limit overfilling the container. 4- The facility is holding a container of flour used to bread raw chicken on a shelf and discarding at the end of the day. During the inspection the flour was discarded. The person in charge reported he would discard the flour between uses.
- Observed wiping cloth buckets stored on top of boxes of bottled beverages at the bar and on top of a covered container of sugar in the kitchen. Also observed a spray bottle with window cleaner stored on a box of bottled beverages at the bar. The wiping cloths and chemical spray bottle were relocated to prevent contamination.
- Observed food employees working in the kitchen without proper hair restraints
- Observed two wiping cloth buckets with no measurable Quaternary Ammonium sanitizer observed with the testing kit. During the inspection the person in charge discarded the solution and titrated to 300 ppm.
- The food establishment is reusing manufacturer containers for food storage (cut lettuce). Informed the person in charge manufacturer containers are not designed to be reused for food storage.
- Observed multiple scratched and scored cutting boards which are used in contact with food.
- The low temperature dishwasher does not have an alarm or visual means to monitor dispensing of detergents and chemical sanitizer.
- Observed the dishwasher temperature reaching 100 degrees F at 100 ppm after 5 cycles. The dishwasher is not meeting the specifications on the data plate (120 degrees F). Instructed the person in charge to contact the technician for repair.
- The person in charge could not provide a Chlorine test kit to monitor sanitization of the dishwasher
- Observed accumulation of debris on the following non food contact surfaces: Charbroiler, back of the fryer, 2 door reach in freezer
- Observed a hose connected to a Y-connector at the service sink without backflow prevention with the hose sitting below the flood rim. During the inspection the person in charge disconnected the hose to prevent contamination. Provided backflow prevention handout during the inspection.
- Observed the dumpster is over filled with boxes and other debris on the ground around the dumpster. The dumpster doors cannot be closed due to the volume of refuse.
- Observed employee personal articles stored on a shelving unit on top of bottled beverages and over packaged foods. The facility has lockers by the back doors for storage of personal belongings.
- Observed 11.9 foot candles of light at the cook line.
- FRED NATS - Third Base Concessions Stand, 42 Jackie Robinson Way Fredericksburg, VA 22401

- Total violations: 3
- Observed 6 handwashing sinks (79 F - 89 F) throughout the kitchen that were not reaching 100 F. During the inspection, the PIC had the water temperature adjusted and all handwashing sink were over 100 F. (Corrected)

- Observed no floor drain grate in front of the handwashing sink.

- Absence of active managerial control observed during the inspection. Employees are not properly trained in food safety, including hand washing procedures, proper cleaning and sanitizing of equipment, temperatures requirements, date marking, cooling procedures as it relates to their assigned duties. observed temperature violations, lack of date markings, lack of hand washing procedures, lack of sanitizing of equipment. The person in charge (PIC) of the kitchen was not available during the inspection, the PIC of the front of the house accompanied the EHS during the inspection, she was knowledgeable, however, she does not oversee the kitchen.
- Improper handwashing procedures observed. Employee washed hands for less than 5 seconds. Observation was discussed with the person in charge, employee was instructed to re-wash their hands.
- Observed the following: 1) employee donned gloves without first washing their hands and handled ready to eat food (lettuce); 2) food employee handled soiled dishes then proceeded in food preparation without first washing their hands. Employees were instructed to wash their hands. Items were discarded.
- A food employee was observed cleaning his hands at the three compartment sink. Employee was instructed to wash his hands only at the handwashing sink.
- No paper towels provided at the handwashing sink near the walk-in-cooler. PIC instructed an employee to provide paper towels.
- Observed a large brown bag of brown sugar near the employees' lockers that was left open and signs of spillage were noticed.
- Observed an employee make a salad using gloves then dropped a piece of lettuce on a soiled tray. The employee picked up the lettuce and placed it in the bowl. EHS explained the procedures with the employee and instructed the employee to discard the salad.
- Observed raw shelled eggs stored over and near ready to eat (RIF)food in the reach in cooler near the reach in cooler. PIC relocated the eggs
- Observed several food contact surfaces that were soiled to the touch and sight throughout the facility. The person in charge moved the items to be washed, rinsed, and sanitized.
- Observed the following 1) a food employee wash two knives and a spatula with soap, rinse with water and dried the items with a towel that was on the cart. 2) an employee wash two pots with with soap, rinse with water, and store in the drying area, failing to properly sanitize the equipment. EHS instructed the employee to properly wash the utensils and equipment (wash, rinse, and sanitize for the required time). EHS informed the person in charge of the requirements to ensure proper procedures are explained to the employees.
- Observed 6 deep containers of cooked rice (43-47'F) that were covered (2 in the prep unit and 4 in the WIC)- condensation was observed on all 6 containers. Per discussion with the person in charge (PIC)- the rice was stored in the cooler overnight. PIC discarded the rice.
- A date marking system is not in proper use for the time/temperature control for safety (TCS) foods.
- The disclosure and reminder for the consumer advisory do not meet the food regulations requirements. The consumer advisory lacks the reminder, it only has the disclosure- Observed no asterisk (*) by the sushi and the cook to order steak.
- Observed a bottle of bleach on the bottom shelf of the cook's cart- near vinegar. A food employee relocated the bottle.
- Observed 6 deep containers of cooked rice (43-47'F) that were covered (2 in the prep unit and 4 in the WIC)- condensation was observed on all 6 containers. Per discussion with the person in charge (PIC)- the rice was stored in the cooler overnight. PIC discarded the rice.
- Observed the following: 1) a packet of completely thawed out fish fish stored in the walk-in-cooler, the instructions on the box stated that the product has to be removed from the packet prior to thawing. 2) a bag of Gyoza (Dumpling) that was thawing on the counter. The person in charge discarded the items.
- Observed the exterior door in the kitchen is not self closing.
- Observed front of the house employees enter the kitchen to prepare salads wearing wrist jewelry. EHS informed PIC of the requirements.
- Observed several wet wiping cloths not stored in a sanitizer bucket throughout the facility. The person in charge placed the wet cloths in the sanitizer bucket.
- Observed in-use utensils stored in water at a temperature of 73'F near the cook line. Utensils were moved to be washed, rinsed, and sanitized. Utensils will be stored in a dry container. EHS discussed alternative methods with the PIC.
- Observed accumulation of debris on the following non contact surfaces: 1) rice cooker, 2) reach in cooler, 3) prep unit, 4) shelving units, 5) cabinets.
- Observed walls, ceiling, and floors in need of detailed cleaning.
- Observed the following in need of repair: 1) re-grout floor tiles, 2) re-caulk 3 compartment sink, 3) coving by the exterior door, 4) re-adjust ceiling tiles, 5) stopper for basin in 3 compartment sink, 6) broken tiles.
- Observed a mask, several covered drinks, a wallet, keys, a container of vitamins, tools, iron, and a jacket stored near food and equipment in the kitchen. The person in charge relocated the items.

- Observed 1 foot candle of light inside the walk in cooler.
- Observed the pressure gauge does not move during the final hot water rinse on the dishwasher. The person in charge reported their plumber has plans to replace the pressure gauge.
- Observed the following TCS foods holding at improper temperatures: 1- Prep cooler #3 (bottom of the unit)- Container of cut lettuce (43 degrees F), sliced cheese (43 degrees F) and cole slaw mixture (45 degrees F). The person in charge reported the foods have been in the unit overnight and voluntarily discarded for safety. 2- Self service display cooler - Single use containers of yogurt which were stacked on top of other containers of yogurt (44, 45 degrees F). The person in charge reported the TCS foods were in the unit for the past 2 days and voluntarily discarded for safety. Discontinue holding TCS foods in the bottom of prep cooler#3 until evaluated by a technician and discontinue stacking TCS foods in the display cooler. Discussed lowering refrigeration temperatures to 38 degrees F.
- The food establishment does not have a certified food protection manager.

- Observed food employee wash their hands under running water and in less than 10 seconds. EHS informed food employee of the proper handwashing procedure. Food employee rewashed hands before returning to work. (Corrected)
- Observed several soiled ladles hanging from the drying rack next to the 3 compartment sink. During the inspection, the soiled ladles were placed in the 3 compartment sink for cleaning and sanitizing. (Corrected)
- Observed four 5 lbs bags of shredded cheese (49 F - 51 F) at improper temperatures in the prep unit. During the inspection, the PIC discarded the cheese. (Corrected)
- Observed sliced tomatoes, mashed beans, and shredded pork on the prep line that were not labeled with time without temperature control. During the inspection, the PIC labeled the food. (Corrected)
- Observed 2 spatulas in a stainless steel container of water (78 F) on the prep table next to the rice cooker. EHS informed the PIC of the proper storage of in-use utensils. During the inspection, the PIC discarded the water and will discontinue storing utensils in water. (Corrected)
- Observed single service articles (food containers, utensils) and napkins being stored over cleaning chemicals on a rack between the dining area and restroom.
- All hanging shelves at the 3 compartment sink are rusted.
- The following are in need of repair: 1. Prep unit is not maintaining temperature. 2. The door handle to the white RIF is loose. 3. The chest freezer gasket is separating from the door.
- The mop sink basin and wall surrounding the mop sink were observed soiled.
- The following are in need of repair: 1. The wall paint is peeling at the 3 compartment sink. 2. Several lights out throughout the kitchen. 3. The lower portion of the back exterior door is rusted and falling apart. 4. The floor paint is peeling in the dry storage room.
