Fredericksburg Restaurant Inspections: Super Rico, Durango Grill
The Rappahannock Area Health District recorded violations at several facilities around Fredericksburg during recent restaurant inspections.
FREDERICKSBURG, VA — Several facilities in the Fredericksburg area recorded violations during recent inspections from the Rappahannock Area Health District. Inspectors conducted the most recent visits between Nov. 7 and Nov. 14.
In Virginia, all food service locations are supposed to be inspected at least once per year. Facilities with higher risk factors may be inspected as often as four times per year, according to the Virginia Department of Health.
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected. Sometimes, the follow-up inspection only considers the most important "priority" violations.

For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions.

It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
Here are the most recent violations as listed by the Rappahannock Area Health Department:
- Koi Tea, 418 Garrisonville Rd #110 Stafford, VA 22554
- Date inspected: Nov. 8
- Total violations: 7
- Person in charge could not provide written documentation on bodily fluid cleanup procedures. Document given during inspection.
- Observed bag of chocolate flavored whey protein powder on a prep table. PIC could not provide documentation stating the FDA approval of the protein powder.
- Per discussion with the person in charge, the reusable net tea bags used to brew tea are only cleaned and sanitized once weekly and the utensils used to scoop out boba once daily. The netted tea bags need to be cleaned and sanitized once daily and the utensils every 4 hours.
- Observed the following held at improper temperature on the non-insulated serving line at 3:30 pm: mango boba (53 degrees F), passionfruit boba (51 degrees F), and strawberry boba (51 degrees F). The boba were put out at 12:00 pm. PIC will discard the boba at 4:00pm. PIC will keep the boba in the reach in cooler moving forward.
- Observed shelving throughout the kitchen rusted and chipping of paint.
- Observed no back flow prevention on spray nozzle connected to a hose at the 3-comp sink.
- Observed the following in need of cleaning: floors underneath equipment, walls behind equipment, floor drains, and caulking of the 3-comp sink.
- Salem Elementary School, 4501 Jackson Road Fredericksburg, VA 22407
- Date inspected: Nov. 8
- Total violations: 4
- Facility does not have a employee that is a certified for protection manager.
- The Person in Charge was unable to provide documentation of training for current staff relating to the Employee Health Policy for this facility.
- Ceiling tiles throughout kitchen and storage area of food facility were made of a material that is not smooth and easily cleanable.
- Observed holes in several ceiling tiles throughout the kitchen.
- Big Burger Pub/Durango Grill, 4256 Plank Road Fredericksburg, VA 22407
- Date inspected: Nov. 8
- Total violations: 8
- Facility was unable to provide a certified food protection manager.
- Handwashing sink at the bar area observed with hot water turned off. Person in Charge turned hot water on at handwashing sink during the inspection.
- Observed interior of the microwave soiled.
- Observed the following non food contact surfaces in need of cleaning: 1. Exterior of cooking equipment 2. Shelving under grill 3. Exterior of home style reach in cooler by cooking equipment.
- Observed ceiling tiles above bar area are not made of materials that are smooth and easily cleanable.
- Observed several ceiling tiles throughout the facility missing.
- Observed floors ,walls and ceilings throughout the facility are in need of cleaning( including under equipment).
- Observed ceiling lights missing shields above the prep area and in both restrooms
- James Monroe High School, 2300 Washington Avenue Fredericksburg, VA 22401

- Observed the following facilities in need of cleaning: 1. EXTREMELY dusty ac/ceiling vents throughout the facility 2. walls of the facility 3. ceiling tiles that are dusty and stained, especially in the front service area

- Date inspected: Nov. 9
- Total violations: 2
- Per discussion with the person in charge, thin probe food thermometer only gets cleaned with alcohol wipes. Food thermometer needs to be cleaned and sanitized at least every four hours with sanitizer as it comes in contact with TCS foods.
- Observed the floors throughout the kitchen and floor drain in need of cleaning.
- La Empanada Sabrosa (12-663UA), 3925 Richmond Highway Stafford, VA 22554
- Date inspected: Nov. 12
- Total violations: 3
- Person in charge could not provide documentation of employee health training but was knowledgeable of symptoms and illnesses requiring reporting. Provided sample employee health policy.
- Person in charge could not provide written procedures for clean-up of vomiting and diarrheal events. Provided sample procedures.
- Absence of backflow preventer to fill freshwater tank with food grade hose. Discussed purchase of hose bib vacuum breaker.
- Super Rico, 2386 Plank Road Fredericksburg, VA 22401
- Date inspected: Nov. 13
- Total violations: 10
- Observed no soap was available in the kitchen hand sink. During the inspection soap was provided.
- Observed no water was available at the front service area hand sink (faucet is not working properly), during the inspection observed a food employee using a shut off valve to wash hands. Discussed with the person in charge getting the faucet repair as soon as possible so that it is working in proper working order.
- Observed no date marking was observed of food items (beans, chicken, spinach) made in house and held for longer than 24 hours. Discussed with the person in charge, during the inspection food items were dated.
- Observed improper thawing methods of frozen fish and a container of beef. Discussed approved thawing methods with the person in charge. During the inspection the fish was placed under cold running water and beef was relocated to the walk in cooler.
- Observed 7 containers of various dried foods without bearing a label of its contents.
- Observed the fryer baskets appear damaged and in poor repair.
- Observed rusted shelves throughout the facility.
- Observed the following non food contact surfaces that require cleaning: 1. wire shelving throughout the facility 2. tops and sides of range and equipment at cook line 3. inside surfaces of all cooling equipment.
- Observed floor drains, floors underneath equipment and walls behind prep/cook areas and walls around dish washing area that require cleaning.
- Observed the following facilities in poor repair: 1. loose and damaged ceiling tiles throughout the kitchen 2. one missing ceiling tile by hood area 3. coving tiles damaged next to chicken grill in the front service area.
- Bowling Green Health & Rehabilitation Center, 120 Anderson Avenue Bowling Green, VA 22427

- A direct connection exists between the drain line of the 3 compartment sink and the sewer system.
- Walker Grant Middle School, 1 Learning Ln. Fredericksburg, VA 22401

- Observed the inside of the warming cabinets and inside the milk coolers require cleaning.
- Observed unnecessary and unused equipment (deep freezer and other miscellaneous) in the front service area.
- Observed the following in need of repair: 1. severely damaged ceiling tiles in the service area, dry storage room and dish room 2. floor along the walk in cooler wall needs finishing with tile and grout 3. chipped coving tiles 4. caulking of two hand sinks in the kitchen.
- Observed ac and ceiling vents require cleaning, in particular vents in the dish room were observed extremely dusty.
- Observed 2 panels missing in the hood vent system. Person in charge stated the panels were broken and new ones have been ordered.

- Date inspected: Nov. 13
- Total violations: 1
- The motion activated sensor at the handwashing sink located by the dry storage area need to be adjusted- it turns off every two seconds and does not turn back on easily. The faucet does not provide a flow of water for at least 15 seconds per the Virginia Department of Health Regulations. Person in charge place an order for the sink to be evaluated.

- Date inspected: Nov. 14
- Total violations: 2
- Person in charge was unable to provide documents on employee health training and policy. EHS provided a sample to the person in charge.
- Observed a container of tomato paste in the walk-in cooler dated 10/30. Through discussion with the person in charge the tomato pasta was opened on 10/30 and put in the walk-in cooler. The person in charge discarded the food during the inspection.
- Lee Hill Elementary School, 3600 Lee Hill School Drive Fredericksburg, VA 22408
- Date inspected: Nov. 14
- Total violations: 4
- A direct connection exists between the drain line of the sanitizing basin of the 3-vat sink and the sewer line.
- There is no covered receptacle for sanitary napkins in the toilet room used by females.
- Observed that the paint on the wooden shelves above the mop sink is peeling and the ventilation grate on the bathroom door is missing.
- The light intensity is below 10 foot candles in the walk in cooler. Measured 2 foot candles in the cooler.
- Capriotti's Sandwich Shop, 44 Mine Road #4 Stafford, VA 22554
- Date inspected: Nov. 14
- Total violations: 7
- Person in charge could not provide documentation on the training of employee health policy. Documentation given during inspection.
- Person in charge could not provide cleanup written procedures for bodily fluid spills. Documentation given during inspection.
- Per discussion with the person in charge, the meat slicer is only being cleaned with chemical sanitizer spray bottle after each use. The meat slicer needs to be washed, rinsed and sanitized due to its contact with TCS foods.
- Observed the sanitizer in wiping cloth buckets read at 0ppm. Directly dispensed sanitizer from the 3-comp sink which also read 0ppm. Observed little amounts of sanitizer flowing and air bubbles throughout the piping of the sanitizer dispenser. PIC stated it will get looked at by technician. PIC will use sanitizer spray bottles instead of wiping cloth buckets in the mean time. Chemical spray bottle read 200 ppm.
- Observed several plastic containers wet while stacked on a rack over the 3-comp sink after being cleaned and sanitized. Items were relocated to the 3-comp sink for cleaning.
- PIC could not provide testing strips to test the concentration of sanitizer.
- Observed the following non-food contact surfaces in need of cleaning: 1) 3-comp sink. 2) handwash sinks. 3) exterior and interior of all prep cooling units. 4) shelving throughout.

- Date inspected: Nov. 14
- Total violations: 1
- Observed the chlorine test strips expired in 2022. During the inspection person in charge ordered new test strips.
- Hampton Oaks Elementary School, 107 Northampton Blvd Stafford, VA 22554

- Observed the interior of ice machine soiled.
- The test strips used for the chemical sanitizer expired in June of 2023.
