Herndon Man Sentenced For Fatal Elden Street Shooting

HERNDON, VA — A man who pleaded guilty to voluntary manslaughter in the 2025 shooting death of a 39-year-old man on Elden Street in Herndon was sentenced Friday to five years and eight months of active incarceration, according to the Fairfax County Commonwealth's Attorney's Office.

Kianmehr Shirinipaziziba was sentenced to 10 years in prison, with all but five years and eight months suspended, Commonwealth's Attorney Steve Descano announced Monday. Prosecutors had sought the maximum 10-year sentence. The active sentence imposed by the judge was at the high end of Virginia's sentencing guidelines for the case.

Shirinipaziziba pleaded guilty May 18 to voluntary manslaughter in the death of Jason Andrew Hann, 39.

Shooting Followed Encounter On Elden Street

The shooting occurred on the evening of May 23, 2025, near Elden Street and Jonquil Lane in Herndon. According to prosecutors, Shirinipaziziba, then 20, was driving a Tesla when he encountered Hann, who witnesses said was behaving erratically in the street and jumping in front of vehicles.

Witnesses testified that Hann kicked the Tesla before Shirinipaziziba shot him once in the chest from inside the vehicle, according to the Commonwealth's Attorney's Office. Shirinipaziziba remained at the scene and said, "I shot him" and "we need to get him some help."

Herndon police said at the time that officers were called to the 300 block of Elden Street around 9:40 p.m. for reports of a disorderly man. Officers found Hann suffering from a gunshot wound and provided treatment before he was taken to a hospital, where he later died. Shirinipaziziba contacted police shortly afterward and admitted shooting Hann, according to police.

Police initially charged Shirinipaziziba with second-degree murder. Several days later, investigators added four felony charges: use of a firearm in the commission of a felony, reckless handling of a firearm, discharge of a firearm in a public space and shooting from a vehicle.

Prosecutors Sought Maximum Sentence

Descano said his office sought the maximum sentence because prosecutors believed Shirinipaziziba had other options during the encounter.

"When the defendant was placed in this situation, he responded with violence instead of any other reaction that could have avoided this tragic outcome," Descano said. "That is textbook voluntary manslaughter and a danger to public safety, which is why my office sought the maximum possible penalty in this case."

The Commonwealth's Attorney's Office said prosecutors argued for the full 10-year sentence before the judge imposed 10 years with four years and four months suspended, leaving Shirinipaziziba to serve five years and eight months.
