DUMFRIES, VA – A Dumfries man is returning to prison for being a felon in possession of a firearm, three years after he was convicted for the same crime, according to the U.S. Attorney’s Office for the Eastern District of Virginia.
Jonathan Daniel Smith of Dumfries was sentenced to three years in prison on April 29 over a fight in Woodbridge during which he fired a handgun.
According to the court, on July 21, Smith got into a fight with another man at a Shell gas station in Woodbridge. Smith pulled out his weapon and the two fought over it, ending up in the gun being fired into the ground.
Smith was arrested three days later after a police chase during which he tried to stash his gun, a Glock 27, and ammunition under a parked car. Witnesses led police to the hiding spot, the court says.
In 2023, Smith had also been convicted of being a felon in possession of a firearm. A person convicted of a felony is not allowed to own a gun in Virginia. A violation of this law is considered a felony itself and can carry punishments from 1 to 5 years in prison. People previously convicted of this crime face stiffer sentences than first offenders.
Smith had pleaded guilty in the case.
