Brookfield Murder Case Inches Towards Trial

Attorneys in the case don't rule out a plea deal for Lynn Hajny for allegedly helping to murder a Brookfield businessman in his home.

A suspect in a Brookfield murder has officially decided not to opt for an insanity plea in the case, but attorneys have left the door open to the possibility of a plea agreement in the case.

Lynn Hajny, 49, appeared in Waukesha County Circuit Court for the second time in a week in order to officially inform Judge Patrick Haughney she will not be seeking a change of her plea from not guilty to not guilty by reason of mental disease or defect. Last week her attorney Michael Hart told Haughney they were planning to not pursue the special plea, but they still needed to receive an assessment of Hajny’s mental health from an investigator.

Hajny is accused of killing businessman John C. Aegerter inside his Brookfield home last June. Her boyfriend Tommy Douyette, 42, pleaded guilty to one count of first-degree reckless homicide in January as part of a plea deal.

Haughney gave Hart and prosecutors until March 30 to file any motions, which would be reviewed at a court hearing tentatively scheduled for April 24. Hart said he expects to file motions.

Attorneys said no plea deal has been reached, but they didn’t rule it out, saying they would inform the judge by letter if it resolves.

Hajny is charged with one count of party to first-degree intentional homicide. Her trial is scheduled to begin May 3.
