Man Charged After Spitting in Firefighter's Face While Drunk

Intoxicated man falling as he walked down Blue Mound Road didn't want emergency officials to check his health.

A Brookfield man is facing charges after he allegedly spit on a firefighter while rescue personnel were trying to examine him after he was found extremely intoxicated on Blue Mound Road.

According to the criminal complaint, Richard A. Kubinski, 44, was walking along Blue Mound Road near Elm Grove Road Tuesday when a person saw him stumbling and falling down and called police. Police found him lying under a tree with his hands placed under his body and after he spotted the squad car, Kubinski then decided to get up and try to walk towards the officer.

Kubinski told the officer nothing had happened and he was alright, but refused to sit down when asked and instead leaned against the squad car’s push bar. He told the officer he didn’t want to say where he was drinking and that he was going to a hotel called “7,8” that he was staying at.

Emergency workers then tried to examine Kubinski, but he physically resisted them, shouted profanities and spat in the eye of a firefighter.

Kubinski was charged in Waukesha County Circuit Court Thursday with one count each of discharging bodily fluids at a public safety worker, disorderly conduct and resisting an officer.
