Man Charged With Spitting, Spits Again

Brookfield man already facing charges for spitting at firefighters while drunk in September, now charged after drunken incident with police.

A Brookfield man is again facing charges after he tried to spit in the eyes of Brookfield police officers after he was found passed out intoxicated Monday.

Richard A. Kubinski, 44, was charged in Waukesha County Circuit Court Tuesday with one count of felony bail jumping and one count of resisting an officer.

According to the criminal complaint:

Police were called to Kubinski’s home in the 16300 block of Siesta Lane Monday after his wife found him passed out intoxicated on the living room floor. The house was also filled with smoke as Kubinski passed out while cooking and his arms were blue from laying on them on the floor.

Officers were eventually able to roll Kubinski over and he was assisted onto the couch after nearly falling over when he stood up. He then refused to take a breath alcohol test and swore at an officer.

He began to resist as officers tried to take him into custody and pinched one of them with the handcuffs until several officers were able to subdue him.

Eventually they were able to get a spit mask on Kubinski and place him on a gurney in order to transport him to the Waukesha County Mental Health Center.
