Man Asks out of 4th OWI Charge Because he 'Raised $10,000 for Police K-9 Units'

A Franklin man was arrested in Racine County for his 4th OWI. He told police it was "B.S." he was being arrested because of his fundraising.

RACINE COUNTY, WI — A Franklin man told police it was "B.S." that he was arrested for OWI in Racine County since he "did so much fundraising for law enforcement." It was his fourth OWI.

According to his criminal complaint, police stopped James Losiniecki's 2008 Chevy Impala on Eight Mile Road approximately a mile-and-a-half from W. Loomis Road on Feb. 25 on a report that he was driving 60 miles per hour in a 45 mile per hour zone.

When police pulled Losiniecki over, he admitted he had 3 or 4 mixed drinks while at a charity event to raise money for police K-9 units. Officers observed Losiniecki had a strong odor of intoxicants coming from the vehicle, slurred speech and glassy eyes, and that his license was suspended, the complaint stated.

According to his criminal complaint, Losiniecki failed five standard field sobriety tests and later agreed to a preliminary breath test. When the officer asked Losiniecki to submit to the breath test, he reportedly asked the officer to just follow him to his girlfriend's house "since he just raised $10,000 for the police K-9 units."

The breath test revealed Losiniecki had a blood alcohol concentration of .147. When he was arrested, he said "it was B.S." he was getting taken into custody because he does so much fundraising for law enforcement, the criminal complaint stated.

When he was transported to the hospital for an evidentiary blood draw, his blood alcohol concentration was recorded at .185, the complaint stated.
