Man Charged After he Doesn't Pull Over for Deputy

Suspect told police he watches a lot of "Cops" and thought the officer was just trying to get somewhere fast.

A 35-year-old Port Washington man is facing charges after he allegedly didn’t stop for an Ozaukee County Sheriff’s deputy because he thought the officer had just turned on his lights to get somewhere faster.

Brian T. Miller was charged in Ozaukee County Circuit Court on Monday with one count of failure to obey an officer. If convicted, he could serve up to nine months in prison and $10,000 in fines.

At 5:24 a.m. Oct. 28, an officer was dispatched to Interstate 43 near Highway H after a call came in regarding a possible road rage incident involving the truck driven by Miller.

The officer arrived to the area to find Miller was driving erratically on southbound I-43 near Highway H, with several cars trailing him. Miller was also braking erratically. The deputy then put on his emergency lights and tried to pull Miller over, but he kept driving.

Miller didn’t speed up during the incident, but eventually pulled off the highway at Brown Deer Road. When asked why he didn’t pull over, Miller told the deputy he watches "Cops" a lot and knows police often put on their lights to get somewhere faster.

When asked why he didn’t pull over, Miller told the deputy he thought he only needed to be in the right lane.

Miller is scheduled to make his initial appearance in court at 8:30 a.m. Jan. 3.
