Peters was arrested after Saukville police responded to a 911 call that a man had been stabbed inside the Walmart store. The weapon, a folding knife with a three-and-a-half-inch blade, was recovered at the scene. After the stabbing, a citizen followed the Peters to parking lot and prevented him from getting into a van; he was then taken into custody.

Peters and Fosco were acquaintances, although the attacked was unplanned. The encounter in the beverage aisle of the store was by chance, but Peters told police he was paying Fosco back for an altercation that the victim had with Peters' roommate earlier.
