Drunk Driver Arrested With 2 Kids In Car Registers .257: Report

A drunk driver more than three times the legal limit was arrested with 2 children in his vehicle, authorities say.

MILWAUKEE COUNTY, WI -- A drunk driver more than three times the legal limit was arrested after authorities say he had two children in the back of the car and then tried to run when he was confronted by officers, according to official reports.

According to the Milwaukee County Sheriff's office, a deputy was on patrol near 27th Street and Lisbon Ave. on the night of Saturday, Nov. 24, when they saw an erratic driver behind the wheel.

Official reports indicated the deputy stopped the driver, later identified as Earl L. McCune III, 32, of Milwaukee, near Hadley Street. The deputy detected a strong odor of alcohol and administered field sobriety tests, reports stated.

Sheriff's officials said that McCune tested a .257 blood alcohol concentration on a preliminary breath test. Wisconsin's legal limit for drunk driving is 0.08. Two children, ages 12 and 6, were in the vehicle. McCune attempted to flee when the deputy began to place him in handcuffs, requiring the deputy to take him to the ground. The Bureau of Child Welfare released the children to their legal guardian.

Sheriff's officials said that a criminal history check revealed that McCune was released from prison in Sep. 2018 for second-degree sexual assault of a child and is on parole for life.

The Milwaukee County Sheriff's office reportedly notified State Corrections officials of McCune’s violations: being with children while unsupervised while driving and while impaired. Officials say that they are recommending official charges of OWI-1st offense, with a child in the vehicle and resisting an officer. If the charges are filed and he is convicted, he could face up to 21 months in jail, according to officials.
