Officers Fired Upon As They Entered Tosa Hotel Room: Complaint

Newly released details show how Wauwatosa officers were injured as they searched for possible victims after getting a shots fired call.

WAUWATOSA, WI— Wauwatosa officers were fired upon as they entered a hotel room searching for possible injured victims on Saturday after getting a shots fired call, according to a criminal complaint.

A Milwaukee man was charged Thursday in connection with the shooting at the Radisson Hotel on North Mayfair Road.

Kenneth Burney, 33, was charged with three counts of attempted first-degree intentional homicide, first-degree reckless Injury as well as other drugs and weapons-related charges, according to online court records.

A future court date was not listed.

Police responded to the hotel around 10:33 p.m. and were directed to the second floor of the hotel. They confirmed that shots had been fired in a hallway, according to the criminal complaint.

Police found firearm casings as well as unspent cartridges on the floor of the hallway, the complaint said.

There were bullet holes in the walls and ceiling and officers began searching for any injured victims, the complaint said.

Burney didn’t answer when police knocked on his door and the master key didn’t open the door, the complaint said.

Radisson staff told police something would have to be blocking the door from the inside for the master key to not work. Police warned that if the door wasn’t open, they would have to force it open, the complaint said.

As police forced the door open, gunshots rang out, the complaint said.

Police said on Monday the following officers were hurt:

  • A 32-year-old sergeant with 11 years of service who sustained two gunshot wounds— one to his hand and another to his thigh.
  • A 31-year-old sergeant with eight years of service. He sustained a graze wound to the foot.
  • A 32-year office with seven years of service. He sustained two gunshot wounds, one to the thigh and one to the knee.

Following the shooting, Burney was taken into custody.

Police found two firearms and several pills which tested positive for ecstasy, the complaint said.

The injured officers were released from the hospital on Monday, according to police.
