According to the criminal complaint, as the Wauwatosa man was driving his girlfriend to work, a vehicle driven by Underwood pulled in front of him and cut him off as they headed easbound on Burleigh Street. The Wauwatosa man responded by honking his horn and "flipping him off."

Both the Wauwatosa man and Underwood turned right onto Mayfair road heading southbound. At that point, the Wauwatosa man passed Underwood's vehicle, only to have Underwood catch up, the complaint said.

As both vehicles approached the Dollar Tree store, the Wauwatosa man saw the driver's side window of Underwood's vehicle roll down, only to reveal Underwood smile and point a handgun at him, the complaint said.

Upon seeing Underwood pointing the gun, he slammed on his brakes and then heard what he believed to be a gunshot. Nobody was reported injured, as the gunshot did not strike the car or any of its occupants, the complaint indicated.

The Wauwatosa man's girlfriend snapped several photos of Underwood's car as it sped off, weaving through traffic as it sped away, police said.

Police Investigate

When police made contact with the registered owner of the vehicle, Underwood's girlfriend, she told police they drove to a friend’s house. At that point, she told polie, they exited the vehicle and removed the license plates from her car to create the appearance that the plates had been stolen.

An arrest warrant has been issued for Underwood. He faces a maximum of 20 years behind bars if he is convicted.
