Family of Naperville Woman Killed While Walking Her Dog Sues Driver

Lawsuit accuses Plainfield man of "wanton disregard for the safety of persons and property." Emily Driscoll died in November.

The family of Naperville’s Emily Driscoll filed a lawsuit Friday against the Plainfield man who killed her and her dog with his car in November 2014. The lawsuit alleges wrongful death and suggests Kenneth Holmberg, 74, drove with “willful and wanton disregard for the safety of persons and property.”

Police ticketed Holmberg for disobeying a traffic control device and failure to exercise due care. Attorney G. Grant Dixon III said the family believes Holmberg should have been cited for more serious infractions. The lawsuit maintains Holmberg was speeding, too, in his 2001 Chevy Malibu.
