Sgt. Rod Mauldin of the Birmingham Police Department said just after 2 p.m. officers responded to a report of shots fired in the 100 block of 5th Avenue Southwest. When police attempted to make contact with Kater, police say he fled to a residence in the 600 block of Center Place South.

Mauldin said Kater "took a tactical position on the porch" of the home and fired at officers. When returning fire, police struck Kater, who was then taken to UAB Hospital where he was pronounced dead.

Mauldin said a handgun was recovered on scene.

The Alabama State Bureau of Investigation has taken over as the investigative agency in the case.
