Homicide In Birmingham Ruled Justifiable

A fatal shooting on Gamma Street in Birmingham Monday afternoon has been ruled a justifiable homicide by police.

BIRMINGHAM, AL — Birmingham police investigators have ruled a deadly shooting that occurred Monday afternoon as a justifiable homicide. The incident occurred just after 1:30 p.m. in the 300 block of Gamma Street.

Mario Kindred, 32, of Fairfield was shot and killed after what police said was an altercation with a woman who later fled the scene before turning herself in to the Birmingham Police Department, according to Sgt. Rod Mauldin.

Kindred was pronounced dead at UAB Hospital later that day.

"Investigators presented the information gathered on the case to the Jefferson County District Attorney’s office for review," Mauldin said in a statement Thursday. "Following the assessment of the information, the Jefferson County District Attorney’s Office ruled the actions justifiable."

Kindred was the 65th homicide victim of the year in Birmingham.
