Appeals Court Rejects New Hearing For Man Convicted Of 2018 Carbon Hill Double Murder

FAYETTE, AL — The Alabama Court of Criminal Appeals has rejected a request to reconsider the case of a man serving life without parole for his role in a 2018 double murder outside Carbon Hill.

According to a notice issued Friday, Sept. 4, the appeals court overruled an application for rehearing filed in the case of Brandon Dewayne Lowery v. State of Alabama, which originated in Fayette County Circuit Court.

The one-page order does not provide additional reasoning for the decision and leaves intact the appeals court's previous decision in Lowery's case.

As Patch previously reported, Lowery pleaded guilty in April 2023 to two counts of capital murder in connection with the shooting deaths of Hernan Antonio Padilla, 55, and Allen Clifford Sandlin, 56.

The two men were found shot to death at Padilla's home outside Carbon Hill on May 1, 2018.

At the time of Lowery's guilty plea, 24th Judicial Circuit District Attorney Andy Hamlin described Lowery as the "ringleader" who devised the plan that resulted in the killings. Lowery was the fourth of five defendants charged in the case to enter a guilty plea.

Michael Council, Lorazo Moran and Lindettia Lynette Lowery also previously pleaded guilty in connection with the killings.

All four are serving life sentences without the possibility of parole.

Alabama Department of Corrections records show Lowery is currently serving his life sentence at Holman Prison.
