Arizona Appeals Court Says DACA Students Not Entitled To Lower Tuition

The court overturned a 2015 decision saying these immigrants were entitled to lower tuition.

Immigrants who received deferred deportation status under a program started by the Obama Administration are not entitled to lower in-state tuition in Arizona. That was the decision Tuesday by the Arizona Court of Appeals.

The decision overturned a 2015 lower court ruling that people covered under the Deferred Action for Childhood Arrivals were considered legally present in the United States and, thus, eligible for lower tuition.

Judge Kenton Jones, in writing the court's majority opinion, said that DACA left it open to each state to decide what benefits they would make available to DACA recipients.
