Ex-Felon Charged With Attempted Homicide

The man has addresses in both Berkeley and Oakland, and has committed felonies in 3 Northern California counties.

OAKLAND, CA — A man with prior felony convictions in three different Northern California counties was arraigned Monday on an attempted murder charge for allegedly stabbing a man in West Oakland late last month.

Troy Foote, 29, who has addresses in Oakland and Berkeley and also has family members in Antioch, is scheduled to return to Alameda County Superior Court on Wednesday for further arraignment.

Foote, who is being held at the Santa Rita Jail in Dublin and listed his occupation as freeway cleanup, is accused of stabbing another man in the area of Sixth and Castro streets, near where Interstate Highway 880
and Interstate Highway 980 merge, at about 3 p.m. on March 29.

Oakland police Officer Gedam Gebremichael wrote in a probable cause statement that Sgt. Jeffrey Smoak saw Foote, who's also known as Harold Levi, in a physical altercation with the victim in which he appeared to
strike the other man in the neck.

When Smoak got closer to the two men he discovered that Foote actually had stabbed the victim, according to Gebremichael. Foote was arrested nearby a short time after the stabbing, Gebremichael said.

When officers searched Foote they recovered a folding knife with dried blood, gloves and bloody shoes, Gebremichael wrote.

A witness identified Foote as being the person who stabbed the other man, according to Gebremichael.

The victim suffered three stab wounds and was listed in critical condition so he wasn't able to provide a statement to police, Gebremichael said.

Prosecutors say Foote was convicted of battery by a prisoner on a non-prisoner in Solano County in 2012, assault with force likely to produce great bodily injury in Monterey County in 2007 and resisting an executive
officer in Amador County in 2007.

Last Christmas Eve Berkeley police issued an alert asking for the public's help in trying to find Foote after he allegedly walked away from the Alta Bates Summit Medical Center in Berkeley against the advice of hospital
staff.

Berkeley police classified Foote as a missing "at risk" person and said he might be suicidal.
