COURT APPROVES GLENDORA REQUEST FOR TEMPORARY RESTRAINING ORDER (TRO)

Glendora, Calif – On Aug. 31, 2020, the Pomona Superior Court approved Glendora’s application seeking a Temporary Restraining Order (TRO) prohibiting the owners of the property located at 1120 E. Sierra Madre Avenue from offering this property for “short term rentals,” advertising the same on any “hosting site,” or from using the same as a “party house” pending a further hearing on the City’s complaint now set for Sep. 30, 2020. The City’s TRO application followed the Glendora Police Department and City staff’s response on Aug. 22 to concerned citizens regarding a planned “Mansion House Party” at 1120 E. Sierra Madre Avenue that resulted in the party organizer receiving multiple administrative citations for violating City Municipal Codes, and current health department orders, totaling $1,900 in fines.
The City will also pursue its claims against Mr. Bell, the party organizer, who did not appear at the court hearing. The Court considered the City’s recent adoption of a 45-Day Moratorium on Short-Term Rentals, and agreed with the position that the TRO should be issued.
The City of Glendora will also seek reimbursement for the costs associated with the response on Aug. 22. Staff has determined that the party promoter and the homeowner have violated Section 9.44.195 of the Glendora Municipal Code. Pursuant to Section 9.44.197 of the Glendora Municipal Code, City Attorney opinion is that the property owner and party promoter are responsible to reimburse the City for various public safety service expenses related to the unlawful party. Staff has tabulated the time expense relative to both the preparation and the handling of the nuisance location on Aug. 22 and will hold both parties liable for that City expense in the amount of $17,909.44 each.
