14,000,000 Reasons to be Happy at the Harkeys this Thanksgiving

Bankruptcy solves so many problems...


  Some time ago I wrote a tongue-in-cheek piece for Patch after Dan Harkey, husband of Assemblywoman Diane Harkey and resident of the ritzy Ritz Cove in Dana Point was found guilty of Elder Financial Abuse and gross fiscal mismanagement of his real estate investment company, Point Center Financial (PCF.)
  Since then, the judge in the months-long Santa Ana case has confirmed the jury award of $11,000,000 and there has been another judgement against him for a couple million or so more.
  I wrote that even paying off the creditors, they would have millions and millions and millions left over. As a plaintiff, I was joyous at the prospect of even having a portion of my investment recovered  
  But it is no more time for tongue-in-cheek pieces.  
  Dan Harkey bankrupted his PCF company and started a new real estate company, Cal Comm Capital and is getting new investors, I understand. 
  Even after filing claims in Bankruptcy Court against Dan Harkey, it is doubtful there will be any immediate payment.  
  Assemblywoman Harkey brought a suit against Senator Mark Wyland for $10,000,000 for comments he made about her husband's trial for which she suffered great mental anguish and even had to see a doctor.
  I wondered how she arrived at that figure, other than to reason the investors in her husband's company also suffered great mental anguish and that was their compensation.
  Since then, though, she has dropped the suit, perhaps because she had always been an opponent of frivolous lawsuits.
  Assemblywoman Harkey has been declaring a profit from PCF on her annual 700 form required by the state.  
 Does she have any conscience about repaying investors some of the millions they  have acquired with legally proven ill-gotten gains?   Not that I heard. 
 She is busy hosting fund-raisers in her bid for the Board of Equalization and deriding the State's 'deplorable economy.'  Yes.  
 An old man I know in Palm Desert had to sell his home waiting for his award.  A friend's investors parents died waiting. I am forced to live on my Social Security retirement.  
 Only 80 plaintiffs sued because Dan Harkey promised the other 2,000 that once the economy got going, he would make good on his promises. He repeatedly derided the plaintiffs and called me a liar for claims I made (Check Google.)
  The economy is flourishing, and they have lost out completely.  
  Yes, the California economy is flourishing for some. 
  The Dow and Nasdaq are reaching records.  Realtors are beaming and real estate is booming.
  And then, there are those who believed in the Harkeys.
