Trailer Ordinance Is In Effect

REMINDER

Effective April 20, 2017 the City's amended parking ordinance prohibits overnight parking of vehicles with attached trailers and unattended tractor-trailer vehicles.

The ordinance grew from community feedback that these vehicles create parking shortages in many areas.

A. Except as provided in subparagraph (C), no person shall (1) stop, park or leave standing, and (2) leave unattended upon any street or highway any time from 12:00 a.m. to 6:00 a.m. any vehicle, which the Department of Motor Vehicles requires a Class A Commercial Driver’s License to operate. Such vehicles may include, but, are not limited to, tractor-trailers, truck and trailer combinations, tractor-trailer buses, tanker vehicles, livestock carriers, and flatbeds.

B. Except as provided in subparagraph (C), no person shall stop, park, or leave standing upon any public street or highway in a “residential area,” as defined in subparagraph (D), any vehicle: (1) in excess of twenty-two (22) feet in length; (2) that has more than two (2) axles; (3) greater than seven (7) feet in height; (4) has a weight in excess of ten thousand (10,000) pounds; (5) used or maintained for the transportation of persons for hire, compensation, or profit, and designed, and used, or maintained for the transportation of property, including buses, motor trucks defined in the Vehicle Code and similar vehicles of a width in excess of ninety (90) inches as measured at the widest portion of the body, not including mirrors or other extensions; (6) that is a trailer, semi-trailer or trailer coach as defined in the Vehicle Code or similar vehicles; or (7) or any item of farm machinery or special-purpose machine.

C. The prohibitions contained in this section shall not apply to: (1) vehicles making pickups or deliveries of goods, wares, services or merchandise to or from any building or structure immediately adjacent to the property on which such building or structure is situated; (2) any ambulance, paramedic or public safety vehicle involved in an emergency; (3) Any vehicle being repaired under emergency conditions, as defined in subparagraph (D); (4) any vehicle belonging to Federal, State or local authorities while conducting official business; and (5) vehicles loading or unloading persons and/or property, for a maximum of seventy-two (72) hours.

D. For purposes of this section: 1. ‘Residential area’ shall include the following: (1) areas zoned for residential use pursuant to Title 9 of this Code and all adopted planned community texts; (2) “residence district” streets as defined in California Vehicle Code Section 515; as well as (3) the following streets: 2nd (north of Los Alisos), Aliso Park, Alton Parkway (east of Portola), Antibes, Bake Lane, Bayfront Lane, Bridgemont, Bywater, Calle Pradera, Canada (Lake Forest to nine hundred (900) feet west of Dimension), Cherry (Jeronimo to Darrin), Cornelius, Dylan, Fawn Ridge Road, Gowdy, Hedgemont Way, Islamare Lane, Jeronimo Lane, Lake Vista Drive, Montcliff, Murin Isle Lane, New Bedford, Normandale, Northcrest, Osterman, Oswego, Palmwood, Paloma, Paseo Sombra, Paseo Tranquilo, Peachwood, Pittsford, Poncha Spring, Regency, Richland Way, Ridge Lane, Ridgeline, Rimgate, Rimhurst, Rue De Fortuna, Rue De Valore, Saddleback Ranch Road, Serrano, Summerwood, Tamarisk, Toledo Lane, Vintage Woods (south side of Lake Forest), and Winding Way. 2. ‘Emergency conditions’ shall mean the need for sudden and unexpected repairs occurring during transport of the vehicle.”

SECTION 4. The City Council’s actions are made upon review of the Staff Report, all oral and written comments, and all documentary evidence presented on the Ordinance.

SECTION 5. All existing provisions of the Code that are repeated herein are repeated only to aid decision-makers and the public in understanding the effect of the proposed changes. Restatement of existing provisions does not constitute a new enactment.

SECTION 6 . If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.

SECTION 7. The documents and materials associated with this Ordinance that constitute the record of proceedings on which the City Council’s findings and determinations are based are located at Lake Forest City Hall, 25550 Commercentre Drive, Suite 100, Lake Forest, California 92630. The City Clerk is the custodian of the record of proceedings.

SECTION 8. The City Clerk shall certify as to the adoption of this Ordinance and shall cause a summary thereof to be published within fifteen (15) days of the adoption and shall post a Certified copy of this Ordinance, including the vote for and against the same, in the Office of the City Clerk, in accordance with Government Code Section 36933.

SECTION 9 . In accordance with Vehicle Code section 22507, this Ordinance shall not become effective until signs or markings giving adequate notice thereof have been placed, but in no event shall this Ordinance take effect earlier than thirty (30) days from and after the date of its final passage and adoption.

PASSED, APPROVED, AND ADOPTED this 21st day of March, 2017.
