TOWN OF CORTE MADERA TOWN COUNCIL NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Corte Madera Town Council will hold a public hearing on proposed ordinance amendments to adopt a new Title of the Corte Madera Municipal Code (Title 22: Objective Design and Development Standards). Title 22 includes objective design and development standards that will be used to evaluate qualifying multi-family housing projects that are submitted to the Town. Recent state legislation limits local jurisdictions’ discretion related to the approval or denial of certain multi-family and mixed-use housing projects. Jurisdictions are limited to using objective standards to evaluate qualifying housing projects. State law defines objective design review standards as involving no personal or subjective judgment by a public official and are uniformly verifiable by reference to an external and uniform benchmark or criterion available and knowable by both the development applicant or proponent and the public official prior to submittal. Title 22 will serve as a supplement to the zoning code and will be applied to qualifying multi-family and mixed-use housing projects. The ordinance amendment does not include rezoning or increasing the density of any property.
Associated amendments are also proposed to Chapter 15.50 (Trees), Chapter 18.02 (General), Chapter 18.04 (Definitions) and Chapter 18.30 (Design Review) of the Corte Madera Municipal Code. The proposed amendments reflect direction from the Planning Commission at their February 23, 2021, April 13, 2021, April 27, 2021, July 13, 2021, and October 12, 2021 public meetings.

Pursuant to the California Environmental Quality Act (CEQA), the Planning Department has determined that the proposed action is exempt pursuant to CEQA Guidelines Section 15061(b)(3) since adoption of the ordinance will not permit any changes to the environment and therefore there is no possibility that the activity in question may have a significant effect on the environment.
