Convicted Killer's Brother Admits to Accessory after the Fact in Los Alamitos Double Murder

Tim Wozniak was not his brother's keeper when it came to murder. Now, he will serve three years' probation.

LOS ALAMITOS, CA — A convicted double murderer's brother pleaded guilty to being an accessory after the fact on Friday. That plea will have him placed on probation until 2019, according to Orange County Senior Deputy District Attorney Matt Murphy.

The testimony of Tim Wozniak, brother of Daniel Patrick Wozniak, played a role in the defendant's being sentenced to death on Sept. 23.

Tim Wozniak pleaded guilty Thursday to being an accessory after the fact. He was sentenced to time served in jail, which was about a week and a half, said Murphy.

"He apologized to the family" of his brother's victims, Murphy said.

Tim Wozniak helped hide evidence against his brother, but he later cooperated fully with authorities, Murphy said.

Daniel Wozniak, 32, a former Los Alamitos community theater actor who killed the victims to raise funds for his pending nuptials and honeymoon, was convicted in December of the 2010 murders of 26-year-old Samuel Eliezer Herr and 23-year-old Julie Kibuishi.

Daniel Wozniak lured Herr to a Los Alamitos theater to shoot him in the back of his head and then, with help from a 16-year-old accomplice he used the victim's ATM card to withdraw money from Herr's bank account.

After the murder, he took the stage in a play in Huntington Beach and then returned to the crime scene to hack off the head and arms of the victim.

The next day, he used Herr's phone to lure Kibuishi to Herr's Costa Mesa apartment, where he shot her and then pulled her pants down to make it appear Herr had raped and killed her to throw off investigators.
