'Glee' Star Mark Salling Won't Be Charged in Rape Accusation

The actor is still facing two federal child pornography charges.

LOS ANGELES, CA -- Former "Glee" actor Mark Salling will not face criminal charges involving rape allegations, with the Los Angeles County District Attorney's Office Monday citing insufficient evidence to file a case.

The finding was first reported by TMZ.com.

Salling, who played Noah "Puck" Puckerman on the Fox TV show "Glee," was accused by a woman who said she met the actor in 2012 at a hotel bar.

She told a prosecutor that the pair began dating and Puckerman eventually pressured her into agreeing to have sex, despite her belief in waiting until marriage.

Salling allegedly told her it was normal to be nervous the first time and gave her alcohol to relax, according the charge evaluation worksheet prepared by a prosecutor.

The alleged victim said she felt pain when the sex began and repeatedly told Salling, "I can't do this," but he didn't stop, even when she cried and yelled, "God forgive me for my sins."

She claimed that she blacked out and awoke to find Salling sleeping next to her but continued to have sex with the actor for several months because she believed that losing her virginity to the actor amounted to marriage.

She alleged that she contracted a sexually transmitted disease from the actor on two occasions and broke off the relationship when she discovered he was sleeping with other women.

The prosecutor reviewing the case said the woman seemed "very emotional over the trauma" and "presents as a credible and accurate historian of the events." But "given the delay in reporting the crime, suspect's apparent denial of the rape in (a call with the victim) and lack of other corroboration, there is insufficient evidence, at this time, to file this case."

Separately, Salling was indicted in May on two federal child pornography charges to which he has pleaded not guilty. A tip from a confidential informant prompted Salling's arrest at his Sunland home last December, according to the Los Angeles Police Department.

TMZ previously reported that Salling in 2015 reached a $2.7 million settlement in the midst of trial of a sexual battery lawsuit brought by ex- girlfriend Roxanne Gorzela.
