Caregiving & Legal Issues

Caregiving not only includes personal care and social activities, it can also include taking care of your loved one's legal affairs.

Along with the day in and day out scheduling of appointments, meals, family visits and more you’ve also got to keep track of the legal aspects of finances and health care. Sometimes you have to take over more than just the daily details so it’s important to have legal resources available to you.
I recently came across the Hearts Of Gold Caregivers website. It offers a list of legal issues family caregivers may need to contend with. Here are some of the concerns that were important for me when I was caretaking Margaret:

• Find a lawyer who can help you establish a will or estate plan for your relative. A lawyer can also provide strong advice on other key developments in the life of your loved one.
• Discuss with your relative important financial aspects such as the location of documents, gaining access to their banking accounts, and stepping in to take over any financial responsibilities they may have.
• Look into the possibility of becoming the power of attorney for your loved one if he or she becomes incapable of self care. Check to see if a durable power of attorney would be best.

• A living will can provide an end of life decision for your loved one should the need arise. This pivotal legal paper can tell a doctor just how much or how little care the person wishes to receive.
• Talk with other family members about your loved one’s intentions and ask their advice should you feel unsure about any matter.
• Have your attorney distribute the proper documents to the doctors, banks, and health care providers.
