How To Collect A Small Claims Judgment

At www.SouthlandLaw.us, we work with people who have obtained judgments, but have been unable to collect. We have all seen Judge Judy or any of those other daytime court shows. Someone sues another person and gets a judgment. But what happens when the other person does not pay?

The law Judgment Enforcement Act requires that the party who is ordered to pay the winning party to actually pay that party. When the person does not pay, there is no mechanism to compel a payment. So what does a person do?

The first step in collecting a judgment is locating a persons assets, determining whether they have equity in that asset, and then finding out the best manner to turn that asset into cash. 

The document necessary to seize any asset is a WRIT. Once you obtain a WRIT from the Court, you will visit the Sheriff in the county where the asset is located and ask the sheriff to seize that asset.
