Oliva, Daughters to Go Before a Judge Wednesday

A hearing is scheduled for Wednesday, Feb. 29 in Martinez.

The trial of Nelson Oliva will continue in a Martinez courtroom Wednesday (see correction) morning, when Judge Steven Austin will consider an objection to the city's against Oliva and daughters Taylor, Gabrielle and Adriana.

Defense for the Oliva's is also set to ask the court to move the trial outside of Contra Costa County, claiming that the family .

The city of Hercules filed a $3 million lawsuit against its former city manager, three of his daughters and former company NEO Consulting in August, alleging breach of fiduciary duty and violation of conflict of interest law.

Lawyers for both the city and the Olivas did not respond to Patch's request for comment on the case.

Oliva awarded millions of dollars in no-bid affordable housing contracts to NEO, while serving as city manager from 2007 to 2011.

In a blurry time line of events, the Oliva’s eventually divested themselves of the company and NEO employee Walter McKinney took over. City records show evidence of McKinney’s NEO leadership dating as far back as 2008. McKinney is being from the Oliva's in the lawsuit.

Under public scrutiny and pressure from colleagues and residents, in Jan. 11 for undisclosed reasons. 

Wednesday's hearing is scheduled for 9 a.m. at 725 Court Street in Martinez.
