Fair Housing in California: Know Your Rights

Finding a place to call home should be an opportunity available to everyone. That's why federal and state fair housing laws exist. They are in place to protect individuals and families from discrimination when searching for, renting, or purchasing housing.

Under federal law, housing providers cannot discriminate based on a person's race, color, national origin, religion, sex, disability, or familial status. These protected classes help ensure that everyone has equal access to housing opportunities, regardless of their background or personal characteristics.

California takes fair housing protections even further. In addition to federal protections, state law recognizes several additional protected classes to promote inclusive communities and equal housing opportunities. These protections include source of income, veteran or military status, marital status, sexual orientation, gender identity and expression, immigration status, age, and other characteristics protected under California law.

Why is this important? Many people are unaware of their housing rights. Across California, individuals and families may experience discrimination without realizing that legal protections exist to help them. Fair housing laws not only protect people during the housing search process, but they also provide important protections after a tenant has moved into a home.

For example, consider a tenant who receives government assistance payments on the third day of each month, while rent is due on the first. The tenant may request an accommodation to align their rent payment date with the timing of their income. In certain circumstances, and with appropriate documentation, a housing provider may be required to consider such a request. Accommodations like these can help prevent unnecessary late fees and financial hardship caused by circumstances outside the tenant's control.

This is just one example of how fair housing protections help create equal opportunities for all. Every individual and every family deserves access to safe, stable, and livable housing. Fair housing also means being treated fairly once you become a tenant. If maintenance concerns are consistently ignored for certain residents, or if some tenants receive preferential treatment while others do not, these may be signs that further investigation is needed.
