SUBJECT: Adopt Resolution Accepting the Phase 1 Park Pathways and City Facility Parking Lot Rehabilitation Project (City Park) Contract as Complete, Authorizing the Filing of Notice of Completion with the San Mateo County Recorder's Office, and Authorizing Release of the Construction Contract Retention in the Amount of $3,352

BACKGROUND:

The Park Pathways and City Facility Parking Lot Rehabilitation Project is a component project of the Street Rehabilitation Project in the approved Fiscal Year 2017-22 Capital Improvement Program. Total project funding of $200,000 is spread over three fiscal years with $100,000 in Fiscal Year 2016-17, $50,000 in Fiscal Year 2017-18 and an additional $50,000 anticipated for approval in Fiscal Year 2018-19. Rehabilitation of park pathways in San Bruno City Park, Commodore Park, Grundy Park, and Pacific Heights Park was identified as the priority for improvements through this project based on the heavy public use these areas receive and their level of deterioration.

This rehabilitation project consists of sealing cracks caused by ground settling and tree roots, removal and replacement of asphalt, and sealing the asphalt surface to prevent water intrusion and to create an even surface. Phase I of this project, rehabilitation of the asphalt pathways in San Bruno City Park, is now complete. Phase 2 will rehabilitate the Commodore Park pathway and some or all of the Grundy Park pathway within the funding available and will be completed in spring 2018. The third and final phase will complete the improvements to Grundy Park and Pacific Heights Park and will be completed after July 1, 2018 pending funding approval by the City Council as currently identified in the Capital Improvement Program. In the event additional project funding is available at the completion of this final phase of work, the remaining project balance will be used to address deficiencies at the Beckner Picnic Shelter parking lot.

In accordance with the City's established procedure, staff is requesting the City Council's acceptance of this project as complete and is seeking authorization to release the retention. After the City Council accepts the project, a Notice of Completion (NOC) is filed with the San Mateo County Recorder.

DISCUSSION:

The Park Pathways and City Facility Parking Lot Rehabilitation Project is part of the City's Capital Improvement Program (CIP) and was approved by the City Council in the Fiscal Year 2017-22 CIP. The City Council authorized award of the contract to American Asphalt Repair and Resurfacing Co., Inc. on March 28, 2017 in the amount of $75,733 to complete the Phase 1 Park Pathways and City Facility Parking Lot Rehabilitation Project at San Bruno City Park.

The contractor has completed all work under this contract and staff is satisfied with its quality and the completion of the project. There are no unresolved stop notices or outstanding claims and the NOC is ready to be filed. Staff recommends that the City Council accept the Phase 1 Park Pathways and City Facility Parking Lot Rehabilitation Project as complete and approve the release of the contract retention.

FISCAL IMPACT:

Phase 1 of the project was completed under the approved contract amount of $75,733. There were no change orders and no costs associated with materials and compaction testing or submittal review and inspection. The total project cost was $67,033, which includes the five percent retention of $3,352.

ALTERNATIVES:

1. Do not accept the project as complete and do not release retention. RECOMMENDATION:

Adopt resolution accepting the Park Pathways and City Facility Parking Lot Rehabilitation Project contract as complete, authorizing the filing of Notice of Completion with the San Mateo County Recorder's Office, and authorizing release of the construction contract retention in the amount of $3,352.
