SUBJECT: Adopt Resolution Authorizing the City Manager to Execute a Construction Contract with Harty Pipelines, Inc. for the Crestmoor Canyon Sewer Replacement Project in the Amount of $244,680, Approving a Construction Contingency of $50,000 and a Total Project Budget in the Amount of $331,380

BACKGROUND:
Water and Sewer Master Plans were approved by the City Council on March 12, 2013 and February 25, 2014, respectively. The City subsequently completed the 10-year prioritized work plan which coordinates the individual improvement projects identified in the master plans into sequenced, bundled construction packages. On June 24, 2014, staff provided a report on the 10-year Improvement Work Plan and presented the following issues that were taken into consideration in developing the overall program priorities:
- Regulatory deadlines that require completion of sewer capacity projects by 2018.
- Sewer condition assessments that identify pipelines requiring replacement.
- Replacement of aging and under-sized sewer infrastructure to reduce infiltration/inflow and ongoing maintenance needs.
- Replacement of aging and under-sized water infrastructure that will improve fire flow reliability and reduce pipeline leaks.
The Crestmoor Canyon Sewer Replacement project was identified as one of the sewer capacity improvement projects in this work plan. Located within Crestmoor Canyon between approximately Concord Way to Engvall Court and adjacent to the fire access road, the existing 8-inch sewer main experiences sanitary sewer overflow (SSO) during wet weather periods. The scope of work for the project involves replacing approximately 1,600 feet of existing 8-inch sewer line with a 12-inch sewer line. Installation of a larger pipe will alleviate the existing capacity deficiency issues within the sewer main.
DISCUSSION:
The project was advertised in the San Mateo County Time newspaper on June 30, 2017 and July 7, 2017. Notice to bidders was sent to forty-two (42) contractors listed in the City's contractor directory, posted on the City's website and provided to five (5) construction distribution centers. A total of seven (7) bids were received and opened on July 21, 2017 as follows:

The lowest bid was received from Harty Pipeline, Inc. in the amount of $244,680, which was approximately $111,220 lower than the engineer's estimate. Staff contacted the low bidder to determine if errors were made on their bid proposal and received a letter from the low bidder stating that they have reviewed their bid proposal and are confident with their bid at the prices quoted. Staff recommends awarding the project to the low bidder, Harty Pipeline, Inc., which has an office located in San Francisco, California. Staff has reviewed the bid materials and determined that the submitted bid is complete and accurate. Harty Pipeline, Inc. has satisfactorily completed numerous sewer pipeline replacement projects for public agencies such as City of San Francisco, Daly City, and Berkeley. Based on their experience and performance with other agencies, staff determined that Harty Pipeline, Inc. meets the qualifications to perform the work for the Crestmoor Canyon Sewer Replacement Project as specified in the contract documents.
As the sewer replacement will be occurring within a location that is not directly adjacent to residences, businesses or public right of way, there will be minimal impacts and disruptions during construction activities. Since pedestrians occasionally utilize Crestmoor Canyon as a hiking trail, trail closed signs will be placed at the project limits during construction work hours. Access to the construction site is through a locked City gate located off of Engvall Court. Engvall Court is a private road that leads to the San Bruno Golf Center and does not lead to any residential properties. Roadway closures are not anticipated and traffic control signs will be placed along Engvall Court to warn passing motorists about construction vehicles entering/exiting onto the roadway. Some construction noise and dust is expected during work hours.
FISCAL IMPACT:
The FY 2017-22 Capital Improvement Program budget for the project includes an allocation of $520,000 for the sewer main replacement to complete the design, bid and construction phases. Staff recommends a construction budget that includes a 20% construction contingency to address potential unforeseen conditions during construction. The total amount from existing carryover balance of $497,619 is sufficient to fund the entire project.

ALTERNATIVES:
- Reject all bids and direct staff to re-advertise the project. This action will further delay the completion of the Crestmoor Canyon Sewer Replacement Project, subject the City to potential SSOs and fines, and possibly result in a higher bid price.
- Do not award the construction contract and do not complete the project. The Crestmoor Canyon sewer main would be vulnerable to system failure which would result in severe SSOs and potential catastrophic situations.
RECOMMENDATION:
Adopt resolution authorizing the City Manager to execute construction contract with Harty Pipelines, Inc. for the Crestmoor Canyon Sewer Replacement Project in the amount of $244,680, approving a construction contingency of $50,000 and a total project budget in the amount of $331,380.
