
Speaker pro Tem Mullin’s Recount Bill Heads to Governor Brown
Provides for state-funded, full manual recount in statewide elections

Sacramento – AB 44 by Speaker pro Tem Kevin Mullin has cleared its final hurdle in the legislative process and is on its way to Governor Brown for signature. This bill will ensure statewide recounts in California are fair and accessible for all voters and candidates by providing a state-funded, full manual recount option at the discretion of the Governor for any statewide office or ballot measure where the margin of victory is 0.015% or 1,000 votes, whichever is lower.

“The need to update our existing recount system was front and center during the recount initiated during the 2014 State Controller’s primary race,” Mullin said. “I believe AB 44 will ensure that the election process is fair and transparent for all voters and candidates.”
Mullin originally addressed this issue in August of 2014 near the end of the 2013-14 legislative year by introducing Assembly Bill 2194. The bill stalled in the State Senate after a procedural vote denied the bill the opportunity for a legislative hearing. His commitment to bringing California’s recount process into the 21st century never wavered and he introduced AB 44 at the beginning of the current legislative year.
“Ensuring a fair and transparent recount process was definitely of bi-partisan interest, and I believe my colleagues in the state legislature truly listened to the criticism of the existing recount process that echoed throughout the state and recognized the merits of the bill,” Mullin stated.
Governor Brown has until October 11, 2015 to sign or veto bills.
