UN-Approved MINUTES - SAN BRUNO CITY COUNCIL - July 25, 2017

1. CALL TO ORDER: THIS IS TO CERTIFY THAT the San Bruno City Council met on June 25, 2017 at San Bruno's Senior Center, 1555 Crystal Springs Road, San Bruno, CA. The Council meeting was called to order at 7:03 p.m.

Presiding was Mayor Ruane, Vice Mayor Ibarra, Councilmembers Marty Medina, Rico Medina and O'Connell. Mario Benavente led the pledge of allegiance. Recording by City Clerk Bonner.

3. ANNOUNCEMENTS:

Mayor Ruane made the following announcements:

  • The Regular City Council Meeting of August 8, 2017 is cancelled, the next Regular City Council Meeting will be held on Tuesday, August 22, 2017 at the San Bruno Senior Center.
  • San Bruno's Annual National Night Out event will be held on Tuesday, August 1, 2017.

4. PRESENTATIONS:

Mayor Ruane read a proclamation recognizing Mario Benavente as the new District Governor of the Lion's Club and Lions Clubs International's Centennial Celebration Day. Vice Mayor Ibarra gave introductory remarks regarding Mario Benavente and he in turn thanked everyone.

5. REVIEW OF AGENDA: No Changes.

6. APPROVAL OF MINUTES: Regular City Council Meeting of June 27th and Special and Regular Meetings of July 11, 2017, approved as submitted.

7. CONSENT CALENDAR:

  • Approve: Accounts Payable of July 10 and 17, 2017.
  • Approve: Payroll of June 30, 2017.
  • Adopt: Resolution Amending the Salary Plan for Unclassified, Part-time, Temporary and Seasonal Employee Classifications.

Councilmember Marty Medina asked Item 7.c. be pulled.

MIS Rico Medinallbarra to approve Item 7.a. and 7.b. and passed with all ayes.

Councilmember Marty Medina asked this item be highlighted. He said the minimum wage was increased and he wanted to recognize the employees. City Manager Jackson said we have about 150 part-time hourly employees who are involved in our aquatic programs, before and after school programs, summer camp activities, community service officers and a number of other part-time employees.

MIS Rico Medina/Ibarra to approve Item 7.c. and passed with all ayes.

  • PUBLIC HEARING: None.
  • PUBLIC COMMENT ON ITEMS NOT ON AGENDA:
  • CONDUCT OF BUSINESS:

Kirsten Pinochi, San Bruno Garbage reported 26 additional people signed up for 20 gallon carts in a three week period, which is a 3% increase. She said they attended the Senior Center Medical Fair with the 20 gallon container and they also publicized the variety of cart sizes in their annual brochure.

Stephen Seymour, Mastick Ave. declared his candidacy for San Bruno City Council.

  • Adopt Resolution Rejecting Bid and Authorizing Staff to Re-Advertise for Bids for the Mill Park Neighborhood Streetlight Conversion Project.
  • Approve Design and Adopt Resolution Authorizing the City Manager to:

Public Services Director Tan gave an overview of the staff report and asked for questions.

Vice Mayor Ibarra questioned five months to design the wiring for 50 lights. Tan said there was a period for the agreements to be signed, and once that occurred the consultant went ahead and started the process.

Mayor Ruane asked if this could be treated as an emergency and get someone on a time and material basis so we would know exactly what it would cost. City Attorney Zafferano said it would be difficult to make the emergency findings because the situation has gone on long enough unless there is some evidence there is an emergency to like property.

Councilmember Rico Medina asked when this would go back out for bid. Tan said by early August and it would hopefully come back to Council by the second meeting in September. He said he also didn't understand why it take so long.

Councilmember Marty Medina asked what will be done to attract the interest of the contractors to bid the job. He was concerned that other foundations and poles might need to be replaced. Tan said the street light poles are being replaced from steel to aluminum and sometimes the foundation of those does not match. Councilmember Marty Medina suggested all the poles be looked at. Tan said there is a program in the CIP to replace the poles.

Vice Mayor Ibarra introduced the resolution for adoption and passed with a unanimous vote.

  • Execute a Construction Contract with JMB Construction, Inc. for the San Mateo Avenue Water and Sewer Replacement Project in the Amount of $4,613,870, Approve a Construction Contingency of $692,081;
  • Execute a Contract for Construction Management and Inspection Services with The Hanna Group in an Amount Not To Exceed $299,325;
  • Approve Capital Improvement Budget Amendment and Appropriate $1,357,688 from the Wastewater Capital Fund;
  • Appropriate $551,937 from the Water Capital Fund; and
  • Approve a Total Budget in the Amount of $5,705,276.

Public Services Director Tan gave an overview of the staff report and asked for questions. Vice Mayor Ibarra was concerned about business owners and resident's reactions. He proposed an early morning meeting with a continental breakfast and suggested maybe Artichoke Joe's could provide parking.

Councilmember O'Connell said improvements for pedestrian safety at mid-block was discussed, she asked if he was saying at Jenevein and San Mateo Avenue. Tan said there was a study done and the suggestion was made one of the cross walks be moved and a flashing light be installed. The City will go to the Traffic Safety & Parking Committee for that intersection.

Councilmember O'Connell asked once it is all paved that the crossing marks be very visible and the TSPC look at what can be improved for that area.

Councilmember Marty Medina said he appreciated how the bids were nicely bunched. He referenced the Vice Mayor's suggestion about getting additional input and suggested it be in Spanish, Chinese and English. He said he hoped the turnaround time for the contracts with JMB are signed soon. He suggested expanded work hours. He asked if the property owner is responsible to pay for the replacement of the sewer laterals. Tan said the sewers are under the sidewalk so the pipeline is extending back to the sewer. Councilmember Marty Medina said he was concerned about the construction management inspection part of this project. Tan said there will be one inspector, full-time and one construction manager, part-time.

Vice Mayor Ibarra said that's why the public needs to be talked to because we want to propose extended hours and they should know. He said if we can extend the hours it could reduce the project time-line.

Councilmember Rico Medina asked if staff has considered extending the hours. Tan said it has not been thought about. Councilmember Rico Medina said we need to communicate the project to the commercial property owners. Contact number and how to get in touch with them would be an option.

Stephen Seymour, Mastick Ave. asked if there is any way to break it into two or three pieces. Tan said presently the traffic re-routing plans are very generic because they have not sat down with the contractor, but once they do they will have a better idea.

Mayor Ruane said the whole program might need to be fine-tuned.

Councilmember O'Connell pointed out the staff report indicated they do not intend to close the whole road at one time.

Councilmember O'Connell introduced the resolution for adoption and passed with a unanimous vote.

c. Receive Oral Report and Review Status of Local Emergency Related to the Truck Collision at the San Bruno Senior Center and Adopt Resolution Continuing Declaration of Local Emergency.

City Manager Jackson gave an update on the status of the demolition and repair of the Senior Center. She said the lunch program is successfully operating at St. Robert's Church and School. She corrected the name of the company that did the initial securing of the building, it was Belfor Restoration Specialists. She said they are continuing to demolish the damaged portion of the building and should be complete in a couple of weeks. She said an update will be provided at the next scheduled Council Meeting on August 22.

Councilmember Marty Medina asked for an update of the costs be brought back on August 22. City Manager Jackson said all costs are being born by our insurance carrier to the extent they can recover any insurance funds from the company whose truck ran into our building. No out-of-pocket costs by the City for this work. Councilmember Rico Medina said there was a $5000 deductible which the insurance will attempt to recoup. He said August 23rd may be the last day St. Robert's is available and the program will have to be moved. He said at one time, there was a Thursday lunch program at the Recreation Center; however, the kitchen is very small. City Manager Jackson said currently a contract provider has been used to provide prepared lunches.

Vice Mayor Ibarra asked about Bingo. Will the insurance cover the loss? City Manager Jackson said Bingo is conducted by a not-for-profit group not affiliated with the City. She said they are working with the not-for-profit to see if the space at the Senior Center would adequately accommodate the crowds they might expect. She said she had no information regarding them relocating somewhere else. Our insurance does not cover lost revenues; however, if they have insurance, it might be possible they could recover funds.

d. Appoint Councilmember O'Connell as the Voting Delegate for the Annual League of California Cities Conference Being Held September 13-15, 2017 in Sacramento and Appoint an Alternate Delegate.

City Manager Jackson said Councilmember O'Connell has expressed her interest in attending; however, she could have a conflict on those dates. She asked Council to consider appointing Councilmember O'Connell as a delegate as well as appointing an alternate delegate. Councilmember Rico Medina volunteered to be the alternate. MIS Ibarra/Marty Medina and passed with all ayes.

  • CLOSED SESSION: (Moved to Closed Session before the regular Council meeting.)

Councilmember Marty Medina said San Bruno had a team that went to the Little League World Series. He said the San Bruno Joe Dimaggio Team are the 2017 State Champions. He also said on Saturday, there will be an all you can eat breakfast at the American Legion Hall from 8:30 a.m. until 11:00 am. The cost is $10.00 for adults and $6.00 for children.

Councilmember Marty Medina said at the last council meeting he attempted to call the vote on the fee increases that were recently approved and he would like to try that again because there is one other councilmember who voted originally no on it. Mayor Ruane asked if anyone else had a comment. Councilmember Marty Medina said he would like to agendize the rate fee increases that were approved a couple of meetings ago to take some action. Mayor Ruane said there is a motion, is there a second? Councilmember Rico Medina seconded, all in favor Councilmembers Marty Medina, Rico Medina and Ibarra, opposed Mayor Ruane and Councilmember O'Connell. Mayor Ruane said we would revisit.

Councilmember O'Connell reminded people about the beautification awards. She said the application is on the website or the City Clerk's office.
