Weapons and Drug Charges Filed Against Couple, But Not For Rolling Gunbattle
The elderly couple seriously injured when their Prius was smashed continue to recover from their injuries.

SAN LEANDRO, CA — A suspect arrested this week in connection with a rolling gunbattle that injured an elderly couple in November has been charged with several felonies for a cache of weapons and drugs found in his apartment but so far is facing no charges for the shootout itself, according to the Alameda County District Attorney's Office.
Marcus Jones, 32, along with his girlfriend, 21-year-old Jennifer Marie Orr, were each charged Thursday with four felonies related to weapons possession and possession of marijuana for sale. Jones is also charged with
being a felon in possession of a firearm and possession of body armor while Orr is charged with two counts of possessing a forged driver's license.
When they searched the couple's apartment in the 1400 block of Thrush Avenue on Tuesday, investigators seized more than $250,000 in cash, 6 pounds of marijuana, an AK-47 assault rifle, three handguns with high
capacity magazines, a ballistic vest and other evidence indicating the apartment was used for storing and packaging drugs, police said.

But Jones has not been charged in the shootout that San Leandro police connected him to when they announced his arrest on Wednesday. District attorney's spokeswoman Teresa Drenick said Thursday that she does not know whether he will be charged with any crime related to that in the future.

The gunfight happened at about 12:30 p.m. on Nov. 17 in the area of MacArthur Boulevard and Interstate Highway 580. The occupants of a Nissan and a black Dodge Charger were shooting at each other as they drove through the area until the Nissan crashed head-on into a Toyota Prius in the 300 block of Dowling Boulevard.
An elderly couple in the Prius was seriously injured and taken to a hospital. Police said on Wednesday that they have since returned home from the hospital but are still dealing with long-term complications from their
injuries.

Police found the alleged driver of the Nissan, 33-year-old Davlon Harris of Oakland, nearby suffering from a gunshot wound. He was taken to a hospital for treatment then arrested and charged with several felonies,
including shooting at an occupied vehicle, negligent discharge of a firearm and shooting from a motor vehicle.
Harris has since been released from jail on $200,000 bail and set to return to court on March 23 in Hayward.
But the Charger driver, allegedly Jones, fled the area and remained at large until this week. Investigators obtained a description of the car using surveillance video and determined the car had been rented to Jones the day before the shooting and returned 12 days after.

Investigators started conducting surveillance on Jones, obtained a warrant for his arrest and search warrants for his apartment, his Cadillac and Orr's black Infinity. On Tuesday, after seeing them return home from the
Oakland Airport, the investigators pounced and arrested them both, seizing a loaded Glock, a bullet proof vest and a large amount of cash from Jones.
A SWAT team then executed the search warrant on their apartment and seized the rest of the contraband. Jones has previously been convicted of drug sales charges, assault with a deadly weapon and second-degree robbery dating back to 2001, according to court records.
Orr is also in Santa Rita on $640,000 bail.
