‘Rockefeller’ Charged With San Marino Murder Appealing Kidnapping Conviction

The Rockefeller impostor charged with the 1985 slaying of a San Marino man is currently serving a sentence for kidnapping his daughter, but one of his attorneys called circumstances of the previous trial "inappropriate," reported the Pasadena Star-News.

, but his attorneys are now focused on his 2009 kidnapping conviction, the Pasadena Star-News reported Thursday.

Gerhartsreiter, who has also claimed to be well-to-do Clark Rockefeller of the famous American family—though the Rockefellers have claimed no such relative exists—is currently serving a four- to five-year sentence in a Los Angeles jail for kidnapping his daughter during a supervised visit. He was previously serving the sentence in Massachusetts, but .

Bones were found in 1994 in the backyard of the Lorain Road home where John Sohus and his wife Linda lived along with John’s mother Ruth “Didi” Sohus and Gerhartsreiter rented a guesthouse. In 2011 the bones were officially identified as that of John Sohus, though his missing wife Linda has never been found.

Defense attorney Jeffrey Denner attributed the kidnapping appeal, which is scheduled to occur Friday morning in Boston, to three factors he believed stemmed from the judge in the 2009 case, according to the Star-News:

  • Denner's belief that Suffolk County Judge Frank M. Gaziano erred in allowing "improper comments" from prosecutors,
  • Judge Gaziano disallowed a change of venue request despite an overabundance of pre-trial publicity
  • Judge Gaziano "eviscerated" what might have been an insanity plea.
