Cannabis Delivery Rule Suit: State Takes Aim At Santa Cruz County

The state is seeking to squelch a county ban that prevents out-of-county cannabis retailers from delivering locally, The Sentinel reported.

SANTA CRUZ COUNTY, CA — The California Attorney General has asked a judge to put a stop to a Santa Cruz County ban that prohibits out-of-county cannabis retailers from delivering weed within county lines, the Santa Cruz Sentinel reported. State regulations allow cannabis to be delivered most anywhere in California, but Santa Cruz County argues that Prop. 64 — passed by California voters in 2016 — empowered local governments to control cannabis sales in their jurisdiction.

Santa Cruz County was joined by 24 California cities in April in a lawsuit challenging the state rules, the Sentinel reported.

Months later in July, Salinas-based East of Eden cannabis retailer sued Santa Cruz County, arguing that it should be able to deliver products there. Attorney General Xavier Becerra sought to join that case in November and asked the judge to stop the Santa Cruz County ban, the Sentinel reported.
