Temecula Divorce Frequently Asked Questions.

Ever since we opened our Temecula office, we've kept track of some of the most common questions that we have been asked by clients.  When faced with a divorce, clients typically want to know as much as they can and we try to answer those questions as thoroughly as possible.

How do I file for divorce?
Almost every client asks this (at least, every client looking to get divorced).  The answer is both simple and complicated.  If no children are involved, there are really only 4 documents needed to file, the most important of which being a petition and summons form which can be found here.  In the event that children are involved, another form joins the mix pertaining to the Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA).

What are the stages of a divorce case?
There are generally 3 stages of divorce.  In the first stage, the petition is filed.  In stage two, the divorcing parties complete their financial disclosures, file motions for orders, conduct discovery, and negotiate settlement terms.  Stage three marks the end of the process, where the parties either come to an agreement or the matter is settled by trial. 

What if my spouse does not agree to give me a divorce?
California is a no-fault divorce state, therefore all you need to do to initiate a divorce is cite "irreconcilable differences" in the petition. 

Do I have to hire an attorney to handle my divorce?
The short answer is no.  In fact, if both parties are amicable, you may be able to handle it yourself.  This is known as "pro per".  However, when significant assets and children, it is highly recommended that you at the very least contact an attorney.  A divorce is a life changing process and you need someone who understands the process fully on your side.
