Bail hearings are presided over by a judge of the court where the criminal case has been filed. The defendant is present and is entitled to the attorney of their choice to represent them at the hearing. If the defendant cannot afford an attorney, the state must appoint an attorney to represent the defendant at the bail hearing. Bail hearings are public and are generally open to anyone.

What Happens at the Bail Hearing

At the bail hearing, the defendant’s attorney is responsible for presenting arguments and evidence to support the request for pre-trial release. The state prosecutor is also present at the hearing and will either agree with the bail request or oppose the request to some extent. The prosecuting attorney can either present an alternative bail proposal or oppose any bail.

In determining appropriate bail, the judge considers a number of factors. The defendant’s character and history are very important. The judge will consider a defendant’s financial condition, family ties to the community, previous record regarding appearing for court hearings, and the overall risk that a defendant will flee the jurisdiction to avoid trial. The judge will also consider whether the defendant poses a threat to any members of the community if released from jail before the trial.

Possible Outcomes of the Bail Hearing

A judge can order that bail be granted without a money bond, releasing the defendant on their own recognizance to return to court. The judge can order that a set amount of bail be required, either through a bond or in cash. In some cases, the judge will deny any bail.

In addition to a bond or cash bail, the court can also set out special conditions for release. If a defendant violates the terms of the bail conditions, bail can be revoked, requiring the defendant to be returned to jail until trial. Bail conditions typically include restrictions on traveling, drug and alcohol testing, curfews, house arrest, restrictions on contacting victims or witnesses, and other reasonable conditions the judge finds appropriate.
