New Jeffco Order Halts Bandimere Speedway Injunction

JEFFERSON COUNTY, CO — A new Jefferson County public health order has rendered the decision about a permanent injunction against Bandimere Speedway 'moot,' a judge ruled Tuesday.

Jeffco Public Health filed a lawsuit against Bandimere Speedway after the Jet Car Nationals July 4. The speedway failed to follow court-ordered public health requirements at the event, health officials said.

Judge Tamara Russell said that she can't legally issue a permanent injunction against the speedway because a new public health order was issued Monday.

The judge told Bandimere Speedway that it would have to follow the new public health order, and asked health officials to work with the business to prevent another lawsuit.

The new order requires venues that host large events to provide a plan outlining how they will adhere to the state's public health orders.

"Specifically, venues holding events with more than one designated activity, which would permit more than 100 people inside or 175 people outside, must submit a plan to JCPH and receive approval in writing prior to such events taking place," health officials said.

The county is close to losing its variance, which was previously approved by the Colorado Department of Public Health and Environment, Jeffco officials said. The county has higher levels of the coronavirus than permitted, and could face rollbacks in reopenings, according to the state.
