Avon Doctor Vindicated

Today, the State of Connecticut Superior Court dropped all charges against Avon physician, Dr. Khosro Pourkavoos, MD

HARTFORD, CT, Sept. 22, 2016 – A three-year ordeal for Avon physician, Dr. Khosro Pourkavoos, MD, is finally over. Today, the State of Connecticut Superior Court dropped all charges against him, after the defense filed papers and affidavits pointing out that he had been the victim of false accusations fueled by sloppy police work.

“Today’s action by the court came about because of the opinions of expert doctors who evaluated all the relevant medical records and concerns of the patients involved in this case,” said one of Dr. Pourkavoos’ attorneys, Jim Bergenn. “Both the state and the defense expert doctors concluded that in each of these studied cases, Dr. Pourkavoos provided medical care necessary for his patients’ own health and safety. After seeing the evidence and the court filing by the defense showing that there never was evidence to support the charges against Dr. Pourkavoos, the prosecutor reported to the court the cases all had to be dropped. The defense memorandum brought out that no one with any medical background ever talked with the patients, much less reviewed the medical care each patient needed the doctor to provide.”

“The real crime here is that 6000 patients had their primary care physician wrongly taken away from them for almost three years, with incalculable adverse effect on their physical and emotional health, caused by this deprivation and these false accusations,” fellow defense attorney Pat Tomasiewicz said. “Today, all these patients will be relieved to learn that the State has dropped all the cases. In addition, these tragic events should offer a cautionary lesson to every medical provider about how easy it is for an overzealous officer to manipulate innocent patients into making false accusations.”

As a result of the extensive work on these cases, Attorneys Bergenn and Tomasiewicz said that Dr. Pourkavoos' legal team will be sharing the lessons learned with Connecticut's lead prosecutors and medical societies. “We have to provide education about these cases to ensure that no doctor in Connecticut providing care for their patients’ own health and safety is ever hit with the absurdity of facing similar false charges -- only because no one with a medical background evaluated the medical treatment first. Whenever a doctor’s medical care is questioned in any context, whether by hospitals, attorneys, regulators, insurance companies, or anyone else, only someone with medical background is supposed to evaluate the facts. This protects the patients themselves, as we saw in these cases, from being misled into believing that clearly necessary medical care is somehow improper only because an investigator with zero medical knowledge suggests it. This harms not only the patients interviewed but also the entire community of those needing medical care. Every medical provider using decades of education, training and experience to help patients, cannot be put at risk of false accusations just because they are providing patients with necessary medical care.”

“A heavy burden has been lifted off of my shoulders with the nullification of those false accusations,” said Dr. Khosro Pourkavoos, MD. “With the support of my family and many of my wonderful patients, I managed to weather this horrific storm. In the end, we were blessed to be able to prove clearly that those heinous accusations were false and I thank all who stood beside me during those difficult times. Everyone supported and encouraged me until the truth came to light. I’m honored by their belief in me.”
