Scheduling Order Released for Ex-Brookfield Superintendent Fired for Improper Spending of School Funds

Former superintendent Anthony Bivona claimed he was improperly fired and was suspended with pay after an audit showed questionable spending.

BROOKFIELD, CT- A scheduling order has been released for the trial of former superintendent of schools Anthony Bivona.

He claimed he was improperly fired and was suspended with pay last May after an audit showed the district was using questionable accounting practices in their annual budgets. The budget was reportedly overspent by more than $1 million dollars.

The termination came after a three hour hearing where six members of the Board of Education voted unanimously to terminate Bivona’s contract. The termination ended his seven year long career with Brookfield Public Schools.

Scheduling order is as follows:

  • A written discovery shall be served on or before: 4/15/2016
  • Depositions of fact witnesses accomplished by: 9/1/2016
  • Disclosure of plaintiffs experts by: 11/3/2016
  • Depositions of plaintiffs experts by: 12/15/2016
  • Independent medical exam accomplished by: n/a Disclosure of defendants experts by: 1/17/2017 Depositions of defendants experts by: 2/17/2017
  • Motions for summary judgment to be filed by: 10/17/2016
  • Motions for summary judgment to be argued by: 12/19/2016

Bivona’s defense was based upon blaming the former business manager, Art Colley, for improper accounting and financial management practices he did not disclose. Colley and his assistant Elizabeth Kerekes are both facing larceny and fraud charges.
