According to the warrant, a woman having a birthday celebration with her three sons in the restaurant told police that another group had begun verbally provoking her sons. Council also made "hand gestures consistent with gang signs," the woman told police. When Council and members of the group, one allegedly holding a dagger, approached the woman they were intercepted by a man who was with the mother, and his co-workers. Council and his group fled, were pursued by the older men outside, where the shots were fired.
