DARIEN, CT — Scott Hapgood, the Darien man facing a manslaughter charge in Anguilla, is looking to have the lawsuit filed by the estate of the 27-year-old hotel worker he is accused of killing dismissed in federal court, writes the Norwalk Hour.

Hapgood was sued by the estate of Kenny Richie Marty Mitchel late last year United State District Court in Connecticut. The lawsuit accuses Hapgood of intentional battery and negligence which caused Mitchel's death, and seeks damages in excess of $75,000.

In seeking the lawsuit's dismissal, Hapgood's lawyers claim he suffered stab wounds in an attempted robbery by Mitchel.

During a vacation with his family, Hapgood and Mitchel got into a physical confrontation in Hapgoods's hotel room, which resulted in Mitchel's death. Hapgood has maintained that he acted in self-defense, but he was charged with manslaughter.

After initially cooperating with Anguillan authorities, Hapgood has refused to return to the island, in part because he fears that the case has been unfairly stacked against him.
