UPDATE: Guilford Votes Against Use of Eminent Domain

Eminent domain was needed to bring public water to some residents in town.

UPDATE: The Special Town Meeting scheduled for Tuesday, November 17, 2016, 7:30 p.m. at the GHS auditorium has been cancelled since the Board of Finance did not recommend the initiation of eminent domain to acquire the utility easement from the Indian Cove Association.

ORIGINAL POST: On Wednesday, Nov. 4, the Guilford Board of Selectmen accepted a petition received and approved by the Town Clerk and set a Special Town Meeting date of Tuesday, November 17, 7:30 p.m., in the Guilford High School auditorium located at 605 New England Road to consider and act upon the request to acquire a water main utility easement under a portion of Lower Road and Daniel Avenue and to initiate eminent domain proceedings, pursuant to the Guilford Town Charter.

The Special Town Meeting is subject to a recommendation by the Board of Finance to initiate eminent domain proceedings. Pursuant to the Guilford Town Charter, the Board of Selectmen referred the petition request to the Board of Finance for its consideration and action.

The Board of Finance will meet on Wednesday, November 11, 2015, 7:30 p.m., at the Guilford/Whitfield Room of the Community Center, located at 32 Church Street to decide whether or not to proceed with the Special Town Meeting on November 17, 2015.

The purpose of the request for the utility easement is to bring public water to the residents of Mulberry Point, Tuttles Point and the Long Cove Associations, after an agreement between the Indian Cove Association Board of Directors and the Town of Guilford was rejected by a vote of Indian Cove Association members over the summer.
