Judge: New Zone Cannot Be Created for Madison Beach Hotel

A superior court ruled against a proposed West Wharf Zoning District.

A change in zoning that would have affected the Madison Beach Hotel has been quashed by a judge.

According to Fox Connecticut, the proposed West Wharf Zoning District, as ruled on by a New Haven Superior Court judge, would benefit only the hotel which is in the middle of a large residential area.

“This would be detrimental to the owners of residences in the area,” the judge said.

The article said that the purpose of the zoning change was to place the hotel under the control of the Planning and Zoning Commission, according to Town Planner David Anderson. He said the hotel currently has to deal with the Zoning Board of Appeals, making it difficult for the hotel to do business.

Madison Beach Preservation Association member Emile Geisenheimer said he was pleased with the judge’s ruling, adding that municipalities shouldn’t create a zone that would benefit only one property owner.
