Herbst was elected first selectman in 2009 at the age of 29; he served in the position for eight years. He was first elected to public office when he was 19-years-old as a member of the town's Planning and Zoning Commission.

He ran for governor in 2018 as a Republican candidate, but didn't win the nomination. More recently he returned to practicing law and has been involved in two lawsuits against the town, according to the Trumbull Times.

Herbst and business partner Adam Greenberg acquired a dilapidated colonial-era home in Madison with plans to demolish it and replace it with two housing units, according to the New Haven Register. Another seven smaller homes would be placed on the rest of the property.

Herbst made a six-minute farewell message and posted it on his Facebook page.
