Man Pointed Gun At Officers During Dispute: Wallingford Police

Police broke up a dispute between two men in a parking lot and one of them is accused of later pointing a gun at officers.

WALLINGFORD, CT — A Haddam man is due in court this week to face charges related to a recent arrest in which police say he pointed a gun at officers during a dispute outside of a restaurant on Main Street last week. Wallingford Police responded to the parking area in front of Gaetano’s Tavern on Main Street, 40 North Main Street, at about 1:11 a.m. on May 7 on the report of a dispute.

Arriving officers separated the two subjects and during an interview one of the men told police that the other had pulled a gun during the argument and pointed it at him, according to Lt. Cheryl Bradley. That officer immediately went over to the other man, later identified as Jose Garibay, and asked the whereabouts of the gun. Bradley said Garibay then stood up and reached into his waistband. Officers ordered Garibay show his hands but Garibay refused to remove his hand from his waistband, according to Bradley.

“As the officer went towards Garibay, Garibay removed the firearm from his waistband and pulled back on the slide, expelling a round from the chamber and consequently loading another live round,” Bradley said in a press release. “As he was doing this, the firearm was pointed in the direction of another officer.

“Garibay was taken to the ground by the officers, however, he continued to resist and disobey their orders to pull his arm out from under him. Once he was subdued, officers stood him up and located a pocket knife attached to his right front pocket. The firearm, a Glock 19C with a round in the chamber had fallen to the ground during the take-down.”

Garibay, 38, of Church Hill Road in Haddam, was arrested and charged with illegal carrying of a firearm under the influence of alcohol, second-degree breach of peace, interfering and resisting arrest and first-degree reckless endangerment.

Garibay was released after posting a $15,000 bond and is due in court on May 19.
