'Sex on the Beach' Woman Sentenced
The Bradenton woman is out of jail, but now must register as a sex offender.
The female half of the couple convicted on lewd and lascivious charges after having sex on a public beach last July has had her day in court to determine sentencing.
Elissa Alvarez, 20, was sentenced to time served Wednesday and was officially released from the Manatee County Jail shortly after the judge’s decision was handed down, jail records indicate.
Alvarez, however, will now have to register as a sex offender with the state of Florida, something her attorney plans to appeal.

Alvarez’s attorney, Gregory Hagopian, told WPTV he finds the outcome “shocking. To say that she’s learned her lesson would be an understatement.”

As of Thursday morning, an appeal had not been filed, Manatee court records indicate.
Meanwhile, the other half of the pair, Jose Caballero, 40, remains in the Manatee County Jail awaiting sentencing following his conviction. Sentencing for Caballero is set for July 6, according to court records.
Caballero is no stranger to the inside of a jail cell. Previous arrests have included such charges as disorderly conduct, possession of a controlled substance and contempt of court.
Assistant State Attorney Anthony Dafonseca said during a post-trial press conference that the state would likely seek the full penalty for Caballero. That was in light of the fact Caballero had been out of prison for less than three years on a prior cocaine trafficking conviction before this most recent felony arrest, he said. The conviction carries a maximum sentence of 15 years. On Wednesday, however, prosecutors indicated they may now only seek a two-year sentence, WPTV reported.
The case against the two began to unfold last July when the two started having sex on a public beach in front of witnesses. The act was recorded on a cellphone by a grandmother and police were called out to the scene by another beachgoer who had had enough of the spectacle.
