$5 Million Lawsuit Makes Waves at SeaWorld, Busch Gardens

The class action lawsuit seeks damages for pass-holders who have been automatically charged.

A Florida man alleges SeaWorld Parks & Entertainment’s policy to automatically renew season passes without cardholders’ permission is all wet.

He’s so adamant in that stance, he filed a $5 million class action lawsuit in Tampa’s federal court this week seeking damages for himself and others affected by the policy, CBS reported. SeaWorld Parks is also the owner of Tampa’s Busch Gardens.

Jason Herman claims that he bought an EZPay Adult pass back in March 2013 and paid it off within 11 months, the Tampa Bay Times reported. Even though the payout was settled, the park kept charging his credit card $35 a month. While the terms of the agreement say automatic renewal is standard, there’s one line in that agreement that’s a sticking point, the paper reported.

“Except for any passes paid in less than 12 months, this contract will renew automatically on a month-to-month basis,” the Times reported is the basis for Herman crying foul.

Since Herman’s pass was paid off in 11 months, he contends the park had no right to automatically renew.

It is unclear how soon the case will be heard.

SeaWorld isn’t the only theme park facing battles in court. Disney is also the focus of a number of lawsuits related to that park’s decision to cancel a service that one allowed the disabled to skip to the front of lines.
